§ 27-6-4 PENALTY.
   (A)   Any person who so absents himself or herself without permission shall be guilty of the offense of truancy and, if of the age of 13 years or older, such violator shall be subject to the penalty set forth below.
      (1)   Upon the first conviction, the payment of a fine in an amount not to exceed $75, in addition to court costs;
      (2)   Upon the second conviction within a one-year period, the payment of a fine of not less than $100, in addition to court costs;
      (3)   In addition to any penalty imposed pursuant to division (1) or (2) above, the violator may be ordered to pay all costs associated with this article;
      (4)   In addition to any penalty imposed pursuant to division (1) or (2) above, the violator may be ordered to fulfill community service hours as directed by the court; and
      (5)   In addition, the failure to pay the costs previously described shall constitute a violation of this article, and subject the violator to the penalties described herein above.
   (B)   If the person who is guilt of truancy is under the age of 13 years, the parent or custodian of the violator is subject to the foregoing fines or community service.
