§ 15-437 USE CHARGES; BASIS FOR CALCULATIONS.
   (a)   Generally. For the purposes of this article, CUSTOMER shall mean the account holder assigned a city water meter (excluding irrigation only meters) and having city wastewater service. For all residential and non-residential customers of the city, except as provided under division (b) below, the basis for the monthly use charges shall be the average monthly metered water consumption for January, February and March each year, which shall be effective from April 1 of the year until April 1 of the following year. New customers shall be billed by the average for the same customer class, until an average monthly metered water consumption for the January, February and March usages can be established. When the city is unable to read the water meter within the base period, the meter consumption shall be estimated based on the customer’s prior history.
   (b)   Car washes.
      (1)   Where water consumption is totally or partially used for a car wash, the basis for the monthly wastewater use charge shall be the average monthly water consumption over the most recent six-month period, from the April reading to the September reading, effective October 1 of each year, and from the October reading to the March reading, effective April 1 of each year.
      (2)   If no average water consumption is available for the applicable period, then the actual monthly water consumption shall be used for monthly wastewater billing purposes until the applicable average water consumption can be established.

§ 15-438 SCHEDULE OF RATES.
   All wastewater bills shall be paid monthly on or before the sixteenth day of the month following the service rendered. The following rates shall be charged for each water meter serving a customer:
   (a)   All city customers. The following is hereby established as rates for wastewater service use by all customers within the city:

$25 per month
Use charge:
$3 per 1,000 gallons water use per month
 
   (b)   All rural customers. The following is hereby established as rates for wastewater service use by all customers outside the city who also receive city wastewater service:

$50 per month
Use charge:
$6 per 1,000 gallons water use per month

§ 15-439 SAME; EXTRA STRENGTH SURCHARGE.
   (a)   An extra strength surcharge is hereby established for those users who produce wastewater with a five-day biochemical oxygen demand (B.O.D.) greater than 300 milligrams per liter (mg/l) or a suspended solids (SS concentration in excess of 350 mg/l).
   (b)   The surcharge shall be computed in accordance with the following formula:
   S=Vw x 8.34 x $0.0946 (BOD-300) + $0.0565 (SS-350)
      Where:
         S = Surcharge in dollars monthly
         Vw = Volume of wastewater in million gallons per month
         8.34 = Unit weight of water in pounds per gallon
         $0.0946 = Unit charge for B.O.D. in dollars per pound
         BOD = five-day biochemical oxygen demand in milligrams per liter
         $0.0565 = Unit charge for SS in dollars per pound
         SS = Suspended solids concentration in milligrams per liter
         300 = Allowable B.O.D. in milligram per liter
         350 = Allowance SS in milligrams per liter

§ 15-440 SAME; WATER FROM NON-CITY SOURCE.
   If any rural user obtains water from a source other than the city’s water system, the charge to such user shall be based on the average monthly metered water consumption by water customers during the months of January, February and March.

§ 15-441 SAME; EXCEPTION.
   Where no wastewater of any kind has been discharged into the wastewater facilities, and the city’s water system has been disconnected from the premises for the entire month, the user shall not receive the monthly billing for use of the wastewater facilities.

§ 15-442 BILLING PROCEDURE; DISCONTINUANCE OF SERVICE.
   Sewer bills and bills for industrial cost recovery charges shall be rendered to the person or legal entity designated by the owner, his or her agent, tenant or occupant to receive the water bill. Sewer bills shall be rendered monthly and shall be due on the first day of each month. If any bill is not paid by the fifteenth day of the month in which it becomes due, a written notice shall be given of the city’s intention to disconnect water service to such premises if the bill is not paid within ten days of such notice, and that if the bill is not paid within ten days, the water service shall be disconnected and shall not be reconnected until all past due bills for wastewater facilities service are paid in full, together with a charge of $20 for reconnecting.

§ 15-443 UNPAID CHARGES; PROPERTY LIENS.
   In the event any charges for the use of the city’s wastewater facilities are not paid within the time and in the manner as provided by this chapter, the City Clerk shall certify to the County Clerk of Pottawatomie County the legal description of the real property enjoying the use and benefit of the wastewater facilities, together with the amount of such charge or charges remaining unpaid. Such amount shall be placed on the tax roll for collection, be subject to the same penalties and be collected in like manner as are other taxes, and shall become a lien upon the real property so served.
