8-2-3: DELINQUENCY PROCEDURE:
   A.   Charges Added To Unpaid Balance: If section 8-2-2 of this chapter is not complied with by the consumer or user of water as set forth therein, then in that event, a five percent (5%) per month penalty on the delinquent balance shall be added to the subsequent bill.
   B.   Delinquent Notices: Delinquent notices will be mailed the day following penalty assessment to the consumer or user of water whose account balance, including penalty, exceeds twenty five dollars ($25.00).
   C.   Default Fee And Additional Deposit Added: When said delinquent account is not paid in full by four thirty o'clock (4:30) P.M. on the twentieth of the month, the city of Vinita shall assess a default fee of fifty dollars ($50.00). Those consumers or users of water whose deposit is less than one hundred dollars ($100.00) will be assessed a fee to increase their deposit to one hundred dollars ($100.00).
   D.   Discontinuance Of Service: When said delinquent account is not paid in full by four thirty o'clock (4:30) P.M. on the twentieth of the month, the city of Vinita shall turn off the water at the meter and lock the meter of said consumer or user. However, in the event that the city of Vinita receives notice of stay due to bankruptcy, termination of service shall be conducted in accordance with the provisions of the bankruptcy laws. The second time the consumer or user fails to pay as set forth above and their water is turned off, an additional meter deposit of one hundred dollars ($100.00) will be assessed.
   E.   Restoration Of Service: Prior to restoration of service, the account must be paid in full, including the default fee and additional deposit fees.
   F.   Delinquent Accounts: Water service may be denied or terminated at the city's sole discretion to any customer and any premises for any person or entity who owes a past due and delinquent utility account who is a recipient, beneficiary or consumer of water, whether such account is offered by some other name or not.
   G.   False Information To Avoid Charges: If the city clerk or designee receives sufficient evidence to indicate that a customer has provided false information to establish water service at a new location to avoid the payment of charges owed at a previous location, the city shall transfer the charges owed to the current account, and the charges shall become a part of the customer's utility bill, at which time the entire bill becomes subject to the city's payment policy.
