4-7-2: BURNING RESTRICTIONS:
   A.   Burning Prohibited; Exception: No person shall wilfully ignite or cause to be ignited any fire out of doors within the limits of the City for the purpose of burning trash, garbage, refuse, litter, rubbish, grass, brush, or any combustible materials whether said fire be in a receptacle or incinerator or not; except times approved by the Fire Chief or his designee, following advance notification from the landowner upon whose property the fire is to be set; persons shall be able to burn lawn, tree and garden waste on the property that it was produced on, providing a water source is available and not to be left unattended.
   B.   Mandatory Extinguishment: The Fire Department shall order the extinguishment of any open burning that creates or adds to a hazardous situation. Owners are required to extinguish the fire upon the order of the Fire Department or if the fire escapes the confined area of the burn pile or container. Failure of an owner to extinguish a fire may result in the Fire Department extinguishing the fire at the owner's expense at a rate currently set for fire runs outside the City limits.
   C.   Transporting To Site Within City: It shall be unlawful for any person, firm or corporation to cause the transportation of any such lawn, tree, and garden waste to any site within the corporate limits of the City of Vinita for the specific purpose of off premises burning.
   D.   Responsibility For Open Burning; Compliance: Persons who conduct open burning in accordance with the provisions of this chapter are not exempt or excused from the consequences, damages or injuries that may result from such conduct, nor are they exempt or excused from complying with all applicable laws, ordinances, rules and orders.
   E.   Compliance With State And Federal Laws: All laws, rules and regulations of the State of Oklahoma, United States Federal government, or any subsidiary agency, department, or branch must be followed and nothing herein shall be construed to change or amend any such laws, rules and regulations.
