(A) Any person violating any provision of this subchapter, for which no other penalty is provided, shall be subject to the penalty provisions of § 10.99.
(B) (1) A person who or which owns, uses or possesses a fire alarm system in a residential structure may not cause or permit more than two false fire alarms and/or nuisance fire alarms in a consecutive 12-month period. A person who or which owns, uses or possesses a fire alarm system in a residential structure that causes or permits a third false fire alarm and/or nuisance fire alarm in any 12-month period shall be subject to a fine of $150. All subsequent false fire alarms and/or nuisance fire alarms in any 12-month period shall be subject to a fine of $150 for each such false fire alarm and/or nuisance fire alarm. Each such false fire alarm and/or nuisance fire alarm shall be considered a separate violation. A person who or which violates §§ 92.01 through 92.04 commits a summary offense and shall, upon conviction, be sentenced to pay a fine of $150 in addition to those fines set forth herein. The fine shall be paid to the township, who shall forward the same to the responding township volunteer fire company.
(2) A person who or which owns, uses or possesses a fire alarm system in a commercial structure may not cause or permit more than two false fire alarms and/or nuisance fire alarms in a consecutive 12-month period. A person who or which owns, uses or possesses a fire alarm system in a commercial structure that causes or permits a third false fire alarm and/or nuisance fire alarm in any 12-month period shall be subject to a fine of $300. All subsequent false fire alarms and/or nuisance fire alarms in any 12-month period shall be subject to a fine of $300 for each such false fire alarm and/or nuisance fire alarm. Each such false fire alarm and/or nuisance fire alarm shall be considered a separate violation. A person who or which violates §§ 92.01 through 92.04 commits a summary offense and shall, upon conviction, be sentenced to pay a fine of $300 in addition to those fines set forth herein. The fine shall be paid to the township, who shall forward the same to the responding township volunteer fire company.
