§ 92.01 DEFINITIONS.
   For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   ALARM. A communication to a township volunteer fire company indicating that a fire has occurred or is occurring.
   COMMERCIAL STRUCTURE. Any building or facility, either open or enclosed, used and sustained for commercial purposes and not intended for residential use. COMMERCIAL STRUCTURES include, but are not limited to, office buildings, community centers, personal service businesses, industrial property, financial institutions, schools and educational facilities, cultural facilities, medical centers, hotels/motels, malls, retail stores, theaters, restaurants, taverns, shopping centers, places of worship, farmland, utility buildings, warehouses and garages.
   FALSE FIRE ALARM. The activation of any fire alarm system not caused by heat, smoke, or fire and results in a response by a township volunteer fire company. The term does not include an alarm caused by naturally occurring weather, seismic or other natural condition; interruption of electrical or telephone service to the alarm user; or malicious criminal activity.
   FIRE ALARM SYSTEM. Equipment which automatically actuates a fire alarm when the detecting element is exposed to fire, smoke, abnormal rise or decrease in temperature or activation of a sprinkler system or manually activated device.
   JURISDICTIONAL FIRE CHIEF. An appointed or elected top ranking or commanding officer of a township volunteer fire company or his or her duly recognized designee.
   NUISANCE FIRE ALARM. The activation of any fire alarm system caused by mechanical failure, malfunction, improper installation, lack of proper maintenance or for any other undetermined cause of activation resulting in a response by a township volunteer fire company.
   PERSON. An individual, corporation, partnership, unincorporated association or other legal entity.
   RESIDENTIAL STRUCTURE. A structure consisting of one or more dwelling units intended to be occupied by one or more persons as separate living quarters and containing sanitary facilities and kitchen facilities.
   TOWNSHIP. The Township of Upper Milford.
