§ 151.02 RESPONSIBILITIES OF OWNERS.
   (A)   Each owner of real estate within the city limits shall be responsible for the following:
      (1)   Maintenance of every dwelling, building, or structure in a condition that equals or exceeds the minimum standards set out in § 151.04;
      (2)   Maintenance in a clean and sanitary condition the shared or public area of the dwelling and premises if there are more than four dwelling units in the dwelling;
      (3)   Elimination of all fire and safety hazards, correction of structural inadequacies, and maintenance of heating equipment and electrical wiring in good repair;
      (4)   Removal of rotted wooden fences, rotted out buildings and frame structures that may provide a harbor for mice and rats;
      (5)   Installation and maintenance of adequate water supplies in the kitchen and bathroom areas;
      (6)   Maintenance of all sanitary fixtures in proper repair;
      (7)   Providing adequate drainage of premises;
      (8)   Elimination and prevention of rodent and vermin infestation;
      (9)   Provision of garbage disposal facilities or garbage containers for all dwelling units in a dwelling containing more than four dwelling units, and for all dwelling units located on premises where more than four dwelling units share the same premises;
      (10)   Elimination of potential hazards on the land;
      (11)   Maintenance of the roof and spouting so the roof does not leak and rainwater is drained and conveyed away from the building so there is no significant dampness in the walls or ceilings; and
      (12)   No person, property owner, landlord or property manager shall knowingly agree to rent, lease, or allow a property to be occupied that is not eligible for water service because of non-payment or under restriction due to any city ordinance.
   (B)   Notwithstanding § 151.03(A)(4), whenever infestation is caused by failure of the owner to maintain a dwelling in a rat-proof or reasonable insect-proof condition, extermination shall be the responsibility of the owner. Whenever infestation exists in two or more of the dwelling units in any dwelling, or in the shared or public parts of any dwelling containing two or more dwelling units, extermination thereof shall be the responsibility of the owner.
   (C)   If an owner fails to satisfy the requirements of any portion of § 151.02(A) or (B), the Enforcement Officer shall send a written notice to the owner, instructing the owner to correct the situation within 14 days; however, when in the opinion of the Enforcement Office such a nuisance constitutes an actual menace and immediate threat to health, the Enforcement Officer shall give the owner three days to correct the situation. Failure of the owner to comply with this notice shall be deemed a violation and, upon conviction, the owner shall be subject to the penalty provided in § 151.99.
