Except insofar as the application thereof is clearly impractical or inappropriate, in view of the context of purposes or penalty as provided, all of the definitions, requirements, regulations, prohibitions, penalties, provisions and sections of the Utah traffic code, Utah Code Annotated title 41, as amended, with a corresponding penalty of infraction, class C misdemeanor or class B misdemeanor, are hereby adopted by the city. Any and all violations thereof shall be considered violations of this section and each such violation shall be subject to the penalties provided in section 1-4-1 of this code. (2014 Code)
A. When appropriate traffic control or regulatory signs giving notice of speeds are posted, the prima facie maximum speed limits designated upon said streets shall apply to the appropriate streets or portions of streets so posted.
B. In the absence of any speed limit sign designating a speed limit applicable thereto, the prima facie speed limit shall be thirty five (35) miles per hour. (1977 Code § 11-323; amd. 2014 Code)
A. Declaration Of Policy: It is declared to be the policy of the city to prohibit the making of excessive, unnecessary loud noises which are unnatural in their place and use and are detrimental to the public health, comfort, welfare and peace and quiet of the residents of the city.
B. Defined: "Dynamic braking device" (commonly referred to as "jake brake") means a device used primarily on trucks for the conversions of the engine from an internal combustion engine to an air compressor for the purpose of braking without the use of wheel brakes.
C. Use Prohibited: No person shall operate or permit the operation of any motor vehicle with a dynamic braking device engaged within the boundaries of the city, except to avert imminent danger. The emitting of any compression noise shall be prima facie evidence of the use of engine compression. (Ord. 10-14-97-A, 3-12-1997)
D. Penalty: Any person violating the provisions of this section shall be guilty of a class B misdemeanor, punishable as provided in section 1-4-1 of this code.
