139.01 POSITION TO REPLACE DIRECTOR OF PUBLIC SERVICE AND SAFETY.
   (a)   The position of City Administrator shall be presumed to supersede and replace the positions of Director of Public Service and Director of Public Safety as previously provided by Ohio statute.
   (b)   Any decisions, contract commitments or prior decisions of the Director of Public Service and Safety shall have continuing force and effect without regard to the elimination by the Charter of such position and the City shall be bound by any obligations heretofore incurred by the proper exercise of the duties of that office.
   (c)   The statutory duties of the City Administrator shall continue to be those provided by pertinent Ohio statutes as to Director of Public Service and Safety until or unless modified by ordinance or resolution of Council.
   (d)   The salary for the City Administrator shall be established by ordinance, payable in substantially equal biweekly payments, subject to all appropriate charges mandated by law or permissive by action of the City Administrator.

139.02 MUNICIPAL BUILDING.
   (a)   All rooms, divisions and compartments of the Municipal Building that were not intended and are not assigned for specific purposes, are hereby entrusted to the care, supervision and control of the City Administrator to be handled and managed in such manner as he deems best and upon such terms and conditions as he may prescribe. The decision of the City Administrator as to the occupancy, nonoccupancy or use of any rooms, divisions or compartments of the Municipal Building shall be conclusive and final.
   (b)   The general management, supervision and control of the Municipal Building is hereby referred to the City Administrator in accordance with the statutes of the State.

139.03 ASSISTANT CITY ADMINISTRATOR.
   (a)   There is hereby created the position of Assistant City Administrator, such position to be filled by appointment by the Mayor, to serve at the pleasure of the Mayor, and to be compensated at the same rate as the City Administrator.
   (b)   The Assistant City Administrator shall not have the authority to undertake contractual obligations, appoint or discipline City employees, and need not at the time of appointment be a resident of the City, but shall obtain such residency within sixty days. Further, the Assistant City Administrator shall possess the qualifications described in Section 6.03(B) of the City Charter. (Ord. 80-5. Passed 1-7-80.)
