§ 150.067 INTERNATIONAL ENERGY CONSERVATION CODE ADOPTED; CONFLICTING REGULATIONS.
   (A)   There is hereby adopted for and by the city a standard code known as the International Energy Conservation Code, 2021 edition, with appendices and amendments thereto, passed and recommended by the International Code Council, Inc., which code is published in book form and which is referred to, incorporated in this section and made a part of this section for all purposes. A copy of such code is filed of record in the office of the City Secretary. Adoption of subsequent amendments, supplement or new edition(s) is automatic upon publication by the International Code Council, Inc.
   (B)   The Building Official shall adopt procedures for the administration and enforcement of this Code.

§ 150.068 TECHNICAL CODE; EXEMPTIONS; INSPECTIONS.
   (A)   Manufacturing or processing plants; exemption from permit requirement. No building or other permit as provided for by the codes described in or adopted by this Code shall be required for work to be performed upon the property of a manufacturing or processing plant or industry, under the following conditions:
      (1)   The location of the work is on property of the plant or industry, which property shall comprise the equivalent of one city block or more and be bounded on all sides by city streets; provided, if one or more sides of the property are bounded by another plant or industry, water, railroad rights-of-way or other artificial objects making a street location impossible or impractical, this requirement shall be met by streets bounding all other areas;
      (2)   The plant or industry retains a registered professional engineer or architect on a permanent basis who shall be responsible for the design and who shall oversee the construction of structures within the plant property; and
      (3)   The work shall meet the requirements of the codes described in or adopted by this Code.

§ 150.069 INTERNATIONAL RESIDENTIAL CODE; AMENDMENTS.
   (A)   The International Residential Code, as existed on 5-1-2001, is the municipal residential building code in the State of Texas. There is hereby adopted for and by the city a code known as the International Residential Code, 2015 Edition with appendices and amendments thereto.
   (B)   The following sections of the code referenced under this section are amended as follows: Section M1305, Appliance Access, is amended by adding new section M1305.1.4.1 to read as follows:
   M1305.1.4.1 New residential dwellings: All dwellings with a five (5) foot side yard setback requirement shall be prohibited from having outside air conditioning units located within the five (5) foot side yard setback.
   (C)   Sec. R105.2 Work Exempt from Permit - the following sections are deleted from adoption:
      1.   One-story detached accessory structures, provided that the floor area does not exceed 200 square feet.
      2.   Sidewalks and driveways.
   (D)   Section R313.2 One- and two-family dwellings automatic fire systems is deleted from adoption.

§ 150.070 INTERNATIONAL EXISTING BUILDING CODE ADOPTED; CONFLICTING REGULATIONS.
   (A)   There is hereby adopted for and by the city a standard code known as the International Existing Building Code, 2021 edition, with appendices and amendments thereto, passed and recommended by the International Code Council, Inc., which code is published in book form and which is referred to, incorporated in this section and made a part of this section for all purposes. A copy of such code is filed of record in the office of the City Secretary. Adoption of subsequent amendments, supplement or new edition(s) is automatic upon publication by the International Code Council, Inc.
   (B)   The Building Official shall adopt procedures for the administration and enforcement of this Code.

§ 150.071 INTERNATIONAL HOUSING CODE; CONFLICTING REGULATIONS; AMENDMENTS.
   (A)   (1)   There is hereby adopted for and by the city a standard code known as the International Housing Code, 2021 edition, with appendices and amendments thereto, passed and recommended by the International Code Council, Inc., which code is published in book from and which is referred to, incorporated in this section and made a part of this section for all purposes. A copy of such code is filed of record in the office of the City Secretary. Adoption of subsequent amendments, supplement or new edition(s) is automatic upon publication by the International Code Council, Inc.

   (B)   The Code adopted by division (A) above is amended as set out in this section: Section 106.1, Appointment, is amended to provide that the Board referred to in such section shall mean the Board of Adjustments and appeals.

§ 150.999 PENALTY.
   (A)   Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99.
   (B)    (1)   A violation of the Water Conservation and Drought Contingency Plan - August 2009, as adopted by § 150.002 of this chapter, shall be a Class C misdemeanor subject to the general penalty provisions of § 10.99 of this code of ordinances.
      (2)   A culpable mental state is expressly dispensed with.

   (C)   (1)   Civil penalty.
         (a)   In a proceeding against the owner or the owner’s representative with control over the premises, the city may recover a civil penalty if it proves that:
            1.   The defendant was actually notified of the provisions of §§ 150.020 through 150.037 of this chapter; and
            2.   After the defendant received notice of §§ 150.020 through 150.037 of this chapter, the defendant committed acts in violation of §§ 150.020 through 150.037 of this chapter or failed to take action necessary for compliance with §§ 150.020 through 150.037 of this chapter.
         (b)   A civil penalty under this division (C)(1) may not exceed $1,000 a day for a violation of an ordinance.
         (c)   A determination made under § 150.024(E) of this chapter is final and binding and constitutes prima facie evidence of the penalty in any court of competent jurisdiction in a civil suit brought by the municipality for final judgment in accordance with the established penalty.
         (d)   To enforce any civil penalty under §§ 150.020 through 150.037 of this chapter, the City Secretary must file with the District Clerk of the county, a certified copy of the order of the Commission panel establishing the amount and duration of the penalty. No other proof is required for a district court to enter final judgment on the penalty.

      (2)   Penalties; violations by corporations.
         (a)   The owner, occupant, mortgagee, lessee, agent or any other persons having an interest in any dangerous building who shall intentionally, knowingly or recklessly fail to comply with any notice or order given by the authority of the Building and Standards Commission of the city, shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be punished for each offense.
         (b)   Any person removing the notice provided for in § 150.035 of this chapter shall be deemed guilty of a misdemeanor and, upon conviction, shall be punished as provided in § 10.99 of this code of ordinances.
         (c)   In case the owner or occupant or lessee of any dangerous building ordered to be repaired or demolished under the terms of §§ 150.020 through 150.037 of this chapter shall be a corporation and shall violate any provisions of §§ 150.020 through 150.037 of this chapter, the president, vice-president, secretary or treasurer of such corporation or any manager, agent or employee of such corporation shall be jointly and severally liable for the penalties provided in this division (C)(2).

   (D)   Any person who shall violate any provisions of the technical codes or amendments to any of them adopted in § 150.068 of this chapter shall be guilty of a misdemeanor and, upon conviction, shall be punished by a fine in accordance with § 10.99 of this code of ordinances.
