(A) Livestock must be contained in an area with fencing adequate to prevent the animals from exiting the confines from which they are housed or kept.
(B) It shall be unlawful for any person to allow or permit livestock owned or possessed by that person to run at large.
(C) A culpable mental state is not required as an element of this offense. It is an affirmative defense to prosecution if the livestock was running at large due to the act of a third person, other than the owner or occupant of the premises, or due to some factor not reasonably foreseeable by the owner or person having possession of the livestock.
(D) Livestock running at large are subject to impoundment by Galveston County designated by the city.
