4-3-2: DUTCH ELM DISEASED TREES:
   A.   Existence Of Diseased Trees: Many of the trees of the village are infected with Dutch elm disease which constitutes a hazard to the community and the property of residents of the village. (1993 Code p. 78 § 404.4-1)
   B.   Removal And Destruction Of Diseased Trees Required: All persons having trees on their property which are infected with Dutch elm disease shall remove said trees at once and shall cause such trees and the refuse incident to the removal of the same to be destroyed. (1993 Code p. 78 § 404.4-2)
   C.   Penalty; Abatement By Village: Any person violating the provisions of this section shall be fined as provided in section 1-4-1 of this code for each such violation; it being hereby determined that the maintenance of each tree with Dutch elm disease shall constitute a separate and distinct offense. If any owner of property shall refuse or fail to comply with the terms of this section after first being fined as provided herein, such tree or trees as shall be infected with Dutch elm disease shall be removed by the village at the expense of the property owner.
