(a) The District may deny applications for retail tobacco and paraphernalia sales licenses, and may recommend to the Board that such licenses be suspended or revoked for any of the following:
(1) The applicant or licensee is giving, selling, or offering to sell cigarettes, tobacco products, or paraphernalia by or from a vending machine to any person under the age of twenty-one (21).
(2) Observation by the District or its authorized agent that the applicant or licensee, or any agent, employee, or representative of said applicant or licensee, has violated any provision of this Chapter.
(4) The applicant or licensee, or its agent, employee or representative, has a conviction for, or is convicted of, a violation of Section 2927.02 of the Ohio Revised Code. In the case of licensees, convictions of the licensee or its agent, employee or representative for a violation of Section 2927.02 of the Ohio Revised Code is a sufficient basis for denying the renewal of a license, for suspending a license, or for revoking a license, if the date of conviction is within two (2) years of the issuance of the current retail tobacco and paraphernalia sales license.
(5) An order by a court of competent jurisdiction that a retail tobacco sales location and/or retail paraphernalia sales location owned and/or operated by the applicant or licensee constitutes a public nuisance.
(6) Information contained in the application for a retail tobacco and paraphernalia sales license is determined by the Department to be false, misleading or inaccurate.
(7) The applicant, licensee or retailer owes fees, penalties or fines pursuant to this Chapter, or for a conviction of Ohio Revised Code Section 2927.02 at any time.
(b) Applicants for a retail tobacco and paraphernalia sales license that are denied a license shall be notified in writing by the District. The denial of an application for a license shall state the reason(s) for such denial with reference to the applicable section(s) of this Chapter. Appeals of denials for a retail tobacco and paraphernalia sales license may be made in accordance with Section 1721.07 of this Chapter.
(c) Retail tobacco and paraphernalia sales licensees that are recommended to the Board for suspension or revocation of their license shall be notified in writing by the District. The recommendation for suspension or revocation of a license shall state the reason(s) for such recommendation with reference to the applicable section(s) of this Chapter. Appeals of suspensions or revocations of retail tobacco and paraphernalia sales licenses may be made in accordance with Section 1721.07 of this Chapter.
