1721.07 APPEALS.
   (a)    Appeals of penalties, and denials, suspensions or revocations of licenses under this Chapter shall be made in writing and submitted to the District within fifteen (15) days of the date on the order or notice assessing the penalty or penalties appealed from, or on the denial, suspension or revocation of a license. The written appeal shall indicate whether a hearing is requested on the appeal.
   The request for an appeal shall not prejudice or otherwise deter pending criminal or civil proceedings which have been initiated.
   Late requests for an appeal may be granted or denied by the District on an individual basis after consideration of the totality of the circumstances including any reason provided for the lateness of the request for an appeal. Late requests for an appeal shall not, however, prejudice or otherwise deter pending criminal or civil proceedings which have been initiated during the late period.
   (b)    Appeals will be heard by the Board in accordance with the procedures of 1721.08 of this Chapter. If a hearing is requested on the appeal, the hearing will be held at the next scheduled Board meeting, if practicable, unless the Board grants an extension for good cause shown. The party requesting the hearing will receive notice by the Board or its representative of the date, time, and location of the hearing.
   (c)    The Board may appoint a referee or examiner to hear matters of the Board, including appeal hearings, in accordance with Ohio Revised Code Section 3709.20(B). In the event that a matter or appeal will be heard by a referee or examiner, the appeal will be heard at the earliest practicable date. The party requesting the hearing will receive notice by referee or examiner, or the Board or its representative, of the date, time, and location of the hearing. As prescribed by Ohio Revised Code Section 3709.20(B), at least one member of the Board must be present at any hearing conducted by a referee or examiner. The referee or examiner appointed to conduct the hearing shall have the same powers and authority in conducting the hearing as is granted to the Board.
