§ 32.02 OVERTIME AND ADDITIONAL COMPENSATION.
   (A)   Executive, Administrative, and Professional Employees.
      (1)   Executive, administrative and professional employees are paid a salary which compensates them for all hours worked and they are exempt from the Fair Labor Standards Act. These employees do not receive additional compensation for hours worked in excess of their normal work day, work week or work period but may receive additional compensation for hours worked on holidays or during vacation time to the extent permitted under § 32.05. The following positions are within this category: City Administrator, Assistant City Administrator, Finance Officer/Tax Commissioner, Health Commissioner, Chief of Police, Assistant Chief of Police, Recreation Director, Assistant Recreation Director, Aquatic Director, Assistant Aquatic Director, Building Official, Fire Chief, Assistant Fire Chief, Superintendent of Public Works, Chief Fire Inspector and Public Health Nurse.

      (2)   There shall be a limited exception from the general rule stated in § 32.02(A)(1) above for the position of Assistant Recreation Director. When an Assistant Recreation Director is required to cover, in addition to his or her own duties, the duties of another Supervisor during the absence of the other Supervisor and is thereby required to work beyond his or her normal hours, the Assistant Recreation Director may receive additional compensation or, upon approval of the Mayor, compensatory time off. The additional compensation or compensatory time will be computed on an hour-for-hour basis at the salary rate of the Assistant Recreation Director. (Ord. 41-1986, passed 6-4-89)
      (3)   There shall be a limited exception from the general rule stated in § 32.02(A)(1) above for the position of Assistant Chief of Police. When an Assistant Chief of Police is required to cover, in addition to his or her own duties, the duties of another Supervisor during the absence of the other Supervisor and is thereby required to work beyond his or her normal hours, the Assistant Chief of Police may receive additional compensation or, upon approval of the Mayor, compensatory time off. The additional compensation or compensatory time will be computed on an hour-for-hour basis at the salary rate of the Assistant Chief of Police.

      (4)   There shall be a limited exception from the general rule stated in § 32.02(A)(1) above for the position of Assistant Fire Chief. When an Assistant Fire Chief is required to cover, in addition to his or her own duties, the duties of another Supervisor during the absence of the other Supervisor and is thereby required to work beyond his or her normal hours, the Assistant Fire Chief may receive additional compensation or, upon approval of the Mayor, compensatory time off. The additional compensation or compensatory time will be computed on an hour-for-hour basis at the salary rate of the Assistant Fire Chief. (Ord. 53-1999, passed 12-15-99)
   (B)   Safety force.
      (1)   Sworn employees of the Police and Fire Departments who are not exempt from the Fair Labor Standards Act shall be paid at the rate of time and one-half their regular hourly rate for all hours worked in excess of the maximum number of hours per 28-day work period permitted under the Fair Labor Standards Act.
      (2)   Full-time sworn employees of the Police Department will be paid at the rate of time and one-half their hourly rate for each hour worked in excess of scheduled work hours during a 14-day payroll period during a work period, or for each hour worked in excess of scheduled work day, whichever is greater.
      (3)   Unsworn employees of the Police Department shall be paid one and one-half times their regular hourly rate for each hour worked in excess of 40 hours in a work week, or in excess of eight hours in one work day if assigned to a five day work week, or in excess of ten hours in one work day if assigned to a four day work week.
      (4)   Whenever it is necessary for an off-duty officer to appear in Mayor's Court, Municipal Court, Common Pleas Court, or U.S. District Court, or appear at a hearing before any tribunal maintained by an agency of state or federal government on matters pertaining to, or arising from police business; or whenever it is necessary for an off-duty officer to appear before the prosecutor for pretrial conference; the officer shall prepare an overtime record form and submit it to the supervisor for approval. Court time shall be compensated at the rate of time and one-half the employee's regular hourly base rate with a minimum of three hours' pay at such rate for court. All other appearances listed above shall be for a minimum of three hours. Compensable court time begins when the employee arrives at his or her destination and ends when the employee is dismissed from the hearing, conference or other proceeding except for appearances in Hamilton County Courts or Federal District Court, where the court time shall commence when the employee leaves his or her residence. Additional court time may be approved by the employee's supervisor in the event that the employee is required to appear at a place located beyond 50 miles from the administrative building of Springdale, Ohio.

   (C)   Other Non-Exempt Employees.
      (1)   All employees not exempt from the Fair Labor Standards Act, other than safety forces, shall be paid time and one-half their regular hourly rate for each hour worked in excess of 40 hours in a work week, or in excess of 8 hours in one work day if assigned to a five day work week, or in excess of ten hours in one work day if assigned to a four day work week. Paid leave time and compensatory time shall not count as hours worked when calculating the hours worked in a single work day. Paid leave time and compensatory time shall count as hours worked, however, when calculating the 40 hour work week requirement.

   (D)   Premium Pay.
      (1)   The employees, subject to the Fair Labor Standards Act, of the Street Maintenance and Park Maintenance Forces, the Custodians, the non-safety force clericals, the full-time Building Inspectors shall be paid a premium rate of double-time for hours worked on Sunday provided that, to qualify for the premium rate, the employee must have worked his scheduled 40 hours during the work week preceding the Sunday. If the employee has not satisfied the proviso by the beginning of the Sunday shift, the employee will not receive the premium rate until after he or she has worked, on the Sunday, the number of hours equal to the number of hours by which he or she failed to meet the proviso.

      (2)   All non-exempt employees other than safety forces shall receive a half-time premium for hours worked on holidays named in this chapter in addition to the holiday pay compensation provided in § 32.05(A), making the total rate for holiday work two and one-half times the employee's base hourly rate.

   (E)   Two-Hour Call-In Minimum.
      (1)   When an employee is required to work overtime as an extension either to the beginning or the end of a scheduled shift, the employee will be credited with the actual hours worked. When an employee is off duty and is called in on an overtime basis, which is not an extension to the beginning of a scheduled shift, the employee will be credited with a minimum of two hours' service whether or not the employee actually works a full two hours.

   (F)   Compensatory Time.
      (1)   With the approval of the Mayor, compensatory time may be granted in lieu of overtime compensation. Such compensatory time shall be calculated on the basis of one and one-half hours of compensatory time for each overtime hour worked for employees not subject to any exemption from the Fair Labor Standards Act. Where compensatory time is approved for hours exempt from the overtime requirements of the Fair Labor Standards Act, compensatory time will be calculated on the basis of one hour of compensatory time for each hour worked. The Mayor may establish an absolute maximum limit for the number of compensatory hours an employee may accumulate; and may require that overtime be compensated in cash rather than in compensatory time off.
   (G)   Non-Duplication.
      (1)   There shall be no duplication or pyramiding of overtime and/or premium pay.
