297.21 DUTY DEATH PENSIONS.
   If a member dies as the result of a personal injury or disease arising solely and exclusively out of and in the course of his or her employment with the City, and such death, injury or disease resulting in death is found by the Board of Trustees to have been the result of his or her actual performance of duty in the employ of the City, the following applicable benefits shall be paid, subject to the condition that the beneficiaries eligible to pensions apply for and are in receipt of worker's compensation on account of the death of the member:
   (a)   The member's accumulated contributions standing to his or her credit in the Members Deposit fund at the time of his or her death shall be paid in accordance with Section 297.23.
   (b)   His or her surviving spouse shall receive a pension equal to his or her weekly worker's compensation converted to an annual basis. Such pension shall begin upon termination of the statutory period for payment of his or her worker's compensation and shall continue until his or her remarriage.
   (c)   His or her unmarried children under eighteen years of age shall each receive a pension equal to such child's weekly worker's compensation converted to an annual basis. Such pension shall begin upon termination of the statutory period for payment of such child's worker's compensation and shall continue until his or her adoption, marriage, attainment of eighteen years of age or death, whichever occurs first. If the spouse's pension is terminated, such child's pension shall be increased by an equal share of such spouse's pension.
   (d)   His or her parents shall each receive a pension equal to such parent's weekly worker's compensation converted to an annual basis. Such pension shall begin upon termination of the statutory period for payment of such parent's worker's compensation and shall continue to remarriage.
   (e)   In no case shall any benefits be paid under this section on account of the death of a member if any pensions become payable under Section 297.20 on account of his or her death.
