297.23 REFUND OF ACCUMULATED CONTRIBUTIONS.
   (a)   If any member ceases to be employed by the City and is not entitled to a pension payable from funds of the Employees Retirement System, he or she shall be paid his or her accumulated contributions standing to his or her credit in the Members Deposit Fund upon his or her written application for the same filed with the Board of Trustees.
   (b)   Upon the death of a member, his or her accumulated contributions standing to his or her credit in the Members Deposit Fund at the time of his or her death shall be paid to such person as he or she nominated by written designation duly executed and filed with the Board of Trustees, provided that no pensions become payable under Section 297.20 on account of his or her death. If there is no such designated person surviving the member, and if no pensions become payable under Section 297.20 on account of his or her death, his or her accumulated contributions shall be paid to his or her estate.
   (c)   Refunds of accumulated contributions as provided in this section may be made in a single sum or in installments as shall from time to time be determined by appropriate rules and regulations adopted by the Board.
