549.19 LICENSE OR PERMIT FOR BLASTING OPERATION.
   (a)   Permit; Fee. No person shall blast with dynamite, gun powder or any other explosive compound within the limits of the Municipality, unless there shall have been issued a written permit from the Fire Chief. The permit shall set forth the conditions and the circumstances under which the blasting may be done. The fee for such permit shall be fifty dollars ($50.00). The permit shall be for such period as the Fire Chief may designate, but not to exceed sixty days. The permit may be renewed by the Fire Chief for an additional period of sixty days without payment of an additional fee.
   (b)   Insurance. Before a permit to do blasting is issued, the applicant for such permit shall file a liability insurance policy in the sum of five hundred thousand dollars ($500,000) for any one individual, and one million dollars ($1,000,000) for any accident, covering bodily injury and wrongful death, and in the amount of one hundred and fifty thousand dollars ($150,000) insuring against property damage of any nature caused by blasting. The policy shall be approved by the Law Director of the Municipality, and the policy or copy thereof shall be filed with the Fire Chief. The policy shall name the Municipality as an additional insured.
   (c)   Regulations for Blasting. A qualified seismograph consultant shall be required at each blasting site with seismograph equipment, and a report of each blasting shall be made to the Fire Chief.
   (d)   Blasting Time Regulated. Blasting operations shall not be conducted between the hours of 7:00 p.m. and 7:00 a.m. nor at any time on Sundays except by special permission of the Fire Chief.
   (e)   Compliance. The blasting contractor shall comply with all relevant rules and regulations relating to blasting as contained in the Statutes of Ohio, the Ohio Fire Code and Section 495 of The National Fire Protection Association (NFPA).
   (f)   Penalty. Whoever violates any of the provisions of this section is guilty of a misdemeanor of the first degree. Each day's violation shall constitute a separate offense. The penalty shall be as provided in Section 501.99.
