The following definitions, terms, phrases, words and their derivations shall apply to this chapter:
(a) "Public swimming pool" means an artificial body of water, with a controlled water supply, used collectively by numbers of persons for swimming or recreative bathing, but not including family swimming pools or wading pools, as defined herein.
(b) “Family swimming pool” means an artificial body of water, with a controlled water supply, over twenty-four inches in depth or 200 square feet of surface area, and used or intended to be used solely by the owner or lessee thereof and his or her family, and by friends invited to use it without payment of any fee. This structure may be built either upon or below the level of the ground, which is not designed or intended to be readily dismantled, stored, or moved from one place to another.
(c) “Public wading pool” means an artificial body of water, with a controlled water supply, not exceeding twenty-four inches in depth and used collectively by numbers of persons for wading.
(d) “Family wading pool” means an artificial body of water, with a controlled water supply, not exceeding eighteen inches in depth or 200 square feet in surface area, and used collectively by numbers of persons for wading, and used or intended to be used solely by the owner or lessee thereof and his or her family, and by friends invited to use it without payment of any fee. Such family wading pools are further defined as follows:
(1) A “portable wading pool” means a container which is designed or used for wading purposes and which may be dismantled, stored or moved from one place to another.
(2) A “permanent wading pool” means a container which is designed or used for wading purposes, built either upon or below the level of the ground, which is not designed or intended to be readily dismantled, stored or moved from one place to another.
(e) “Board of Health” means the Board of Health of Cuyahoga County or its duly authorized successor, agency or official.
