§ 50.61 TREE PLANTING REQUIREMENTS.
   These requirements shall apply to any new planting or replacement of trees in the village.
   (A)   Size of parkway trees. Parkway trees shall have a trunk diameter (measured 12 inches above the ground) of not less than two and one-half inches. All new streets shall have parkways planted with parkway trees with trunk diameters (“DBH”) of not less than two and one-half inches.
   (B)   Spacing.
      (1)   Trees that may attain a mature height of over 50 feet shall be planted not more than 40 feet apart (as measured from trunk to trunk), not less than 20 feet apart, and not within 20 feet of any other tree located on either public or private property.
      (2)   Trees that may attain a mature height of less than 50 feet shall be planted not more than 30 feet apart (as measured from trunk to trunk), not less than 20 feet apart, and not within 20 feet of any other tree located on either public or private property.
      (3)   Small ornamental trees shall be planted not less than 15 feet apart (as measured from trunk to trunk) or within 15 feet of any other tree located on either public or private property.
   (C)   Location.
      (1)   Except as provided in division § 50.61(C)(3), trees shall be planted at least five feet from all sidewalks, driveways or other paved areas.
      (2)   Trees shall be centered in the parkway, unless the Director determines that conflicts with utilities, sight lines or public safety would prevent such a location.
      (3)   If the width of the parkway is less than five feet, only small ornamental trees shall be planted.
      (4)   No tree shall be allowed to be planted if parkway is less than three feet.
      (5)   No trees shall be planted in violation of § 50.24 of this code.
      (6)   Only small ornamental trees may be planted under overhead electric power lines.
      (7)   No vegetation shall be planted that interferes with the inspection of the root flare or trunk for parkway tree. Any damage or removal to the vegetation shall not be replaced and is not the responsibility of the Village of South Elgin.
   (D)   Tree species. When selecting parkway trees, preference shall be given to species native to the Northern Illinois region. All trees shall be transplanted from stock grown in Northern Illinois. The following trees shall not be planted in the village:
