(a) It shall be prohibited and unlawful for any person who owns, leases and/or otherwise occupies and controls real property in the City to fail to keep and maintain the external areas of real property free and clear of all health and/or safety hazards or to keep and maintain all grass, lawn, weeds, briers or other vegetation, or otherwise violate the duties as set forth and described in Section 951.01.
(b) In the event that the Property Board, the City Engineer, Building Inspector or the designee of any of them determines that a violation of Section 951.02(a) has occurred, then, in addition to the penalties permitted and provided for in Section 951.99, the Property Board, City Engineer, Building Inspector or the designee of any of them shall serve on the owner of the real property and the occupant thereof, if not the same person, a written notice of violation of Section 951.02(a) describing the violations that require correction and which shall expressly provide such person(s) the opportunity to comply with Section 951.02(a) within five (5) calendar days of the delivery of such written notice to the owner or occupant of such real property as permitted in Section 951.02(c).
(c) The written notice of violation of Section 951.02(a) describing the violations that require correction shall be adequate if delivered in any one or more of the following manners:
(1) Hand delivery by the City Engineer, Building Inspector, City police officer or other designee of the Property Board to any person over the age of eighteen (18) years located at the real property which is the subject of such notice of violation;
(2) Posting such written notice of violation in a conspicuous place on the primary structure locate on or at the real property which is the subject of such notice of violation; or
(3) Delivery by the United States Postal Service by first class mail, postage prepaid, addressed to the owner of the real property at the last known address of such person within the records of the City at the time of mailing. (Ord. 2107. Passed 7-3-08.)
