(a) Garbage and recycling containers. The occupant, owner, or manager of every dwelling house, apartment, construction site, place of business, or building shall provide at least one garbage container and one recycling container for each premises. Owners, occupants, or managers shall cause all garbage, animal waste, and rubbish to be deposited into the garbage container, and all recyclable materials deposited into the recycling container.
(b) Yard waste container. The occupant, owner, or manager of every dwelling house, apartment, construction site, place of business, or building shall ensure all yard waste is deposited into either a Kraft-type paper bag designated for yard waste or a rigid, leak-resistant container with a rigid lid to fit the container.
(c) Residential rental units. The owner or manager who rents, leases, or lets dwelling unit(s) for human habitation shall provide, in a location accessible to all dwelling units, garbage and recycling containers with sufficient capacity to prevent the overflow of garbage or recyclables from occurring. For single-family dwelling units and duplexes, the containers may be provided by the tenant, if a written lease so provides.
(d) Container size, structure, markings, and maintenance.
(1) Size and structure. With the exception of Kraft-type paper bags authorized for yard waste, each container shall be rigid in structure, leak-resistant, and equipped with a rigid lid that fits the container and is removed only for the purpose of cleaning the container, depositing materials into the container, or removing contents from the container. Each container will also be of suitable size to prevent the overflow of garbage, recyclables, and yard waste from occurring.
(2) Markings. Residential recycling containers shall be plainly marked for recycling and accommodate single-stream recycling.
(3) Maintenance. Every container required by this chapter shall be maintained in as sanitary condition as possible in view of the use to which it is put and shall be thoroughly cleaned as needed by washing, sanitizing, or otherwise.
