§ 8-2-7 CONTRACTORS, RESPONSIBILITIES.
   The contractor performing the work shall be responsible for enforcing safety and maintaining safe working conditions in all trenching, shoring, and backfilling to conform to OSHA regulations. The contractor shall employ qualified, properly trained personnel to design shoring, perform safety inspection of the trenches, and supervise other operations involving safety procedures.

§ 8-2-8 BACKFILLING, CERTIFICATION REQUIRED.
   Any person or entity having responsibility for the street cut as set forth in this chapter shall, at the time of the completion of any backfilling required by this chapter, provide certification by a licensed professional civil engineer, journeyman plumber, certified town operator, or the Town Building Inspector, that the backfilling meets the specifications set forth in this chapter.

§ 8-2-9 RESPONSIBILITY FOR STREET RESTORATION.
   Any private individual, contractor, utility, company, agency, or any person representing a contractor, utility, company, or agency, who has disturbed, or is planning to disturb (dig across, dig holes, dig alongside, dig under, and the like) the streets of the town for any reason, shall be totally responsible for restoring the street to at least as good condition as it was prior to the disruption, including pavement, concrete, and backfill to be compacted to 98% of the pre-existing condition, as determined by the Town Engineer.

§ 8-2-10 NOTIFICATION OF TOWN.
   Any person or company or agency planning to disturb the street shall notify the Town Clerk-Treasurer at least 24 hours in advance of the disturbance. Included in this notification shall be:
   (A)   Who shall take responsibility for disturbance;
   (B)   Reason for disturbance;
   (C)   Location of disturbance;
   (D)   Length of time the street will be disturbed; and
   (E)   Who is doing the actual restoration.

§ 8-2-11 INSPECTION.
   At the completion of the restoration, the Town Engineer or other town designee shall inspect the work and sign a release of responsibility if the work is done to his or her satisfaction. The original shall be kept on file at the Town Hall and a copy will be given to the responsible party.

§ 8-2-12 BARRICADES.
   Any person, company, utility, or agency performing work upon the streets of the town shall provide adequate barricades and any other protection as may be necessary when the project or work presents a hazard to motorists or pedestrians.

§ 8-2-13 EMERGENCY, SUSPENSION OF PROVISIONS.
   Regulations of this chapter will be suspended in the event an emergency exists, i.e., broken line, and the like.

§ 8-2-14 PENALTY.
   Unless specific penalties are provided in this chapter, any violation of this chapter shall be a misdemeanor subject to general penalty provisions in § 1-4-1.
