A. Nothing in this chapter shall be deemed to be a waiver of all defenses available to the town under the Colorado governmental immunity act. Particularly, the town shall not be liable for any injury or damage to any remains, personal effects, monument, marker, landscaping, improvement, or other structure or item in the cemetery resulting from allegations sounding in tort, including alleged negligence.
B. Any person who violates the provisions of this chapter or the rules and regulations set forth herein shall, upon conviction, be punished by a fine of not more than five hundred dollars ($500.00) and may further be subject to an order of restitution for damage caused. Each day that the violation shall continue shall constitute a separate and distinct offense. (Ord. 294, 7-9-2013)
