PARK BOARD
§ 94.35  PARK BOARD ESTABLISHED.
   (A)   The Silverton Park Board is established under the authority of Article XII of the Charter.
   (B)   The Board shall be empowered to operate, equip and maintain any or all of the parks, playgrounds, gymnasiums, swimming pools, and recreation centers presently owned or operated by the city or which may be owned or operated by the city in the future, under the supervision and control of the Council. This section shall apply to all facilities located within the municipality.
   (C)   The Board shall be subject to the responsibilities stated in R.C. §§ 755.12, 755.13,  and 755.15 through and including 755.18.
   (D)   The Board shall consist of five members appointed by the Council for five year terms except that the members of the first appointed Board shall be appointed for such terms that the term of one Board Member shall annually expire thereafter.
   (E)   The members of the Board shall serve without pay.
   (F)   Should a Board seat become vacant before the expiration of its term, the Council may appoint a member to complete the balance of the incomplete term in a manner similar to the original appointment procedure.
   (G)   The members of the Board may elect their own chairman, secretary, and such other necessary officers to serve for a period of one year, and may utilize such other persons who are not members of the Park Board as approved by the Council.
   (H)   The Board may adopt such rules and regulations for park and recreational activities as necessary within the municipality with the approval of Council.

§ 94.36  PARK BOARD FUNDS.
   (A)   Monies raised separately by the Park Board are to be deposited to the General Fund of the city but segregated by book entry and used and encumbered only for purposes as designated by the Park Board.
   (B)   The Park Board is given permission to expend funds from these separately designated monies by voted approval of the Board up to $500 without prior approval of the City Manager. Expenditures over $500 by the Park Board shall require the prior approval of the City Manager.

§ 94.99  PENALTY.
   Whoever violates any provision of this chapter for which another penalty is not already provided, shall be guilty of a misdemeanor on a first offense; on a second offense within one year after the first offense, such person is guilty of a misdemeanor of the fourth degree; on each subsequent offense within one year after the first offense such person is guilty of a misdemeanor of the third degree. In addition to the above penalty, the violator may be barred from using any recreation areas of the city for a period not to exceed one year, or both.
