949.99 PENALTY.

   (a)   For a violation of Section 949.04 the resident shall pay to the Village, at the Office of the Clerk-Treasurer, the sum of ten dollars ($10.00), provided the same is paid within seventy-two (72) hours following the offense. After seventy-two (72) hours but no more than thirty (30) days following the offense, the resident shall pay the sum of twenty-five dollars ($25.00). Thereafter, the resident shall pay the sum of fifty dollars ($50.00). If no payment is received in forty-five (45) days following the offense, the period for summary disposition of the violation will lapse and a citation to the Stow Municipal Court will be issued, where the maximum fine levied for each offense shall be Fifty dollars ($50.00) plus court costs.

   (b)   For a violation of any other section of Chapter 949 (949.01, 949.02, 949.03, 949.05, 949.06, 949.07), the penalties shall be as follows:

      (1)   The first offense shall be a minor misdemeanor.

      (2)   The second offense and subsequent offenses shall be a fourth degree misdemeanor.

      (3)   In addition, a second or subsequent violation by a hauler may result in the revocation of the hauler's license.
