918.05   RATE STRUCTURE.
   (a)   The owner of each and every lot and/or parcel of land within the City that contains impervious area which contributes directly or indirectly to the storm water system of the City shall be jointly and severally liable for charges resulting from the storm water utility fee. The fact that the City carries an account in the name of a tenant or other non-owner does not relieve the owner(s) of liability for stormwater charges for the premises.
   (b)   All properties having impervious area within the City of Sidney will be assigned an Equivalent Residential Unit (ERU) or a multiple thereof. Each lot and/or parcel of land within the City with impervious area will have at least one (1) ERU:
      (1)   All residential properties, as defined in Section 918.01(p), are assigned one (1) ERU. The flat rate will apply to all residential properties.
      (2)   All non-residential properties, as defined in Section 918.01(i), are assigned an ERU multiple based upon the individually measured impervious area (in square feet) of the property divided by 2,752 square feet (1 ERU) but in no event less than one (1) ERU. The mathematical calculation will be to the first decimal place and rounded according to mathematical convention.
   (c)   The storm water service fee shall be two dollars and sixty-nine cents ($2.69) per Equivalent Residential Unit (ERU) per month comprised as follows:
      (1)   Stormwater Maintenance:      $0.73
      (2)   Stormwater Monitoring:      $0.36
      (3)   Stormwater Capital:         $1.60
      (4)   Total Monthly Stormwater ERU:   $2.69
   (d)   For all nonresidential properties, the total square footage of impervious area shall be measured by the City based on the records of the County Recorder or County Auditor; City Engineering Drawings and Plans; questionnaires completed by the property owners; field measurements or photogrammetric analysis.
   (e)   All property owners proposed for development after the date of the adoption of this chapter shall include, on all preliminary and final plan drawings submitted to the City in connection with the subdivision approval process, a certification as to the total square footage of impervious surface area to be located on the property following development.
   (f)   The average square footage of impervious area for residential property as defined in Section 918.01 and used as the basis of one ERU shall be reevaluated every five (5) years by the Utilities Director through field measurements or photogrammetric analysis.
