1262.04 SPECIAL RESTRICTIONS.
   The special restriction or restrictions to which the identifying letters in the charts in Section 1262.03(a) through (l) are as follows:
   (a)   A conditional use permit, as provided in Chapter 1246 is required for this use in this zone.
   (b)   The rooming and boarding of not more than two guests is permitted.
   (c)   Up to four dwelling units are permitted if sufficient land area is available.
   (d)   The entire business shall be conducted within a building.
   (e)   A residential use is permitted only above the ground floor of a business building.
   (f)   [For future use.]
   (g)   Repair work for this use is permitted if conducted wholly inside a building.
   (h)   The maximum gross floor area of a building permitted for this use is 6,400 square feet. Incidental, non-nuisance-producing processing, packaging or fabricating is permitted if conducted entirely within a building.
   (i)   Lots shall be improved to the same standards required with respect to parking lots in Chapter 1270.
   (j)   Preliminary and final site plans shall be submitted to the Planning Commission for review and approval.
   (k)   [For future use.]
   (l)   Living quarters for a watchman of commercial or industrial use property, or for hotels and motels, are the only permitted residential uses in this zone.
   (m)   This use must be incidental or related to a professional use of the building. The principal entrance for such incidental or related use shall be from inside a building only.
   (n)   Horses and other livestock used solely for non-business recreation of the occupier are permissible in the quantity of one animal per lot or, if a lot comprises one acre or more, one animal per each whole acre. Shelters for such animals shall be situated not less than fifty feet from the property line and not less than fifty feet from a residence on another lot or tract.
   (o)   [For future use.]
   (p)   A yard shall be enclosed with a minimum of an eight foot Class Six fence to screen the contents of the yard from the general public.
   (q)   A yard shall be enclosed with a minimum of a six foot Class Five fence to screen the contents of the yard from the general public.
   (r)   A yard shall be enclosed with a minimum of an eight foot Class Three fence to secure the contents of the yard from the general public.
   (s)   A yard shall be enclosed with a minimum of six foot Class Three fence to secure the contents of the yard from the general public.
   (t)   The facility MUST have adequate off-street parking for truck trailer staging.
   (u)   No internal combustion engines are permitted. Only electric motors are permitted.
   (v)   No more than nineteen compressed gas bottles on hand are permitted, provided such are stored in accordance with State and Federal laws.
   (x)   Permitted use.
   To defray the costs associated with the repair and maintenance of roads, particularly on the perimeter areas within the City, or in the zoning jurisdiction outside of the City corporate limits when truck or heavy equipment traffic is expected to be established or expanded due to a conditional use permit, an annual road maintenance fee as determined by the Planning Commission in an amount of up to twelve thousand dollars ($12,000) shall be required as a condition for issuance of a conditional use permit. The fee will be paid proportionately on a monthly basis with the first payment due at the time the conditional use permit is granted. Any permit for which such a fee is set will be issued for a specific time period up to one year. A permit holder who wishes to continue the use must reapply to the Planning Commission.
