6-5-17: CITATIONS AND PROSECUTIONS:
   A.   Issuance Of Citations: Animal control officers and police officers are authorized to issue citations on a reasonable belief that any person has violated any provisions of this chapter. Said citations shall be issued in forms approved by the chief of police. Citations shall be issued personally to the violator, left with a responsible family member of at least thirteen (13) years of age at the home of the violator, or mailed to the residence of the violator. Persons issuing citations shall ensure that a copy of the citation is filed with the village clerk on the same day that the citation is issued or as soon as practical after issuance of such citation.
   B.   Payment To Avoid Prosecution: On receipt of a citation alleging a violation of any section of this chapter, the minimum fine provided in this chapter may be paid to the village clerk or at the county animal control center; provided, that the amount is paid within ten (10) working days of issuance of the citation.
   C.   Prosecution Of Violations: After ten (10) working days have elapsed from the date of the issuance of a citation authorized by this chapter, action may be taken by the village attorney or state attorney's office to file a complaint and prosecute the alleged violation in the circuit court or other appropriate administrative tribunal.
