4-4-3: APPLICATIONS - PERMITS - FEES:
   A.   Permits Generally: In all cases, the approving authority for all permits under this section shall be the Village President. In the event a licensee or prospective licensee or applicant disagrees with any action taken by the Village President, an appeal may be made directly to the Village Board of Trustees at a regularly scheduled Village Board meeting within thirty (30) days of written notice being given to the Village Administrator. Permits shall be issued as is permissible by and in compliance with this chapter, the Village's Liquor Code and all other applicable provisions of this Code and the Illinois Video Gaming Act. All permits issued hereunder shall be valid between July 1 and June 30 of the calendar year issued. Fees shall be due on an annual basis at the time of issuance of the permit and shall not be prorated. Persons who do not meet the requirements for a liquor license, who have been convicted of any gambling offense, or who do not meet the requirements for obtaining a license set forth in the Video Gaming Act shall not be eligible for or issued any license or permit under this section.
   B.   Establishment Permit: Any establishment, as defined by licensed establishment, licensed fraternal establishment, licensed truck stop establishment or licensed veterans establishment in section 4-4-1 of this chapter entitled to utilize video gaming in accordance with this chapter and the Illinois Video Gaming Act must hold a permit from the Village. An application for the permit shall be developed by Village staff and at a minimum must contain the following information: 1) the applicant's type of establishment; 2) the applicant's authority to conduct video gaming under the Video Gaming Act and any applicable provisions of this Code; 3) the number of gaming terminals to be utilized; 4) the proposed terminal operator; 5) the proposed distributor; 6) the applicant's eligibility to obtain a liquor license and any past gambling offenses; 7) all information, including any applications submitted to the Illinois Gaming Board; 8) any and all permits or related documentation applicant has received from the Illinois Gaming Board; and 9) a diagram of the premises and proposed location of the video gaming terminals. The application shall otherwise ensure applicants meet the requirements for a liquor license, the requirements for licensure under the Video Gaming Act and have not been convicted of any gambling offense. The permit shall serve as the authority to conduct video gaming at an establishment, subject to approval from the Illinois Video Gaming Board. Upon issuance of a permit, there shall be a registration fee of two hundred fifty dollars ($250.00) per video gaming terminal. A permit applicant shall be entitled to a refund of the registration fee if the Illinois Gaming Board does not grant a license to the applicant to conduct video gaming.
   C.   Terminal Operator Permit: A terminal operator who owns one or more video gaming terminals being used within the Village must obtain a permit from the Village and must register each video gaming terminal with the Village. Applications for a terminal operator permit shall be developed by Village staff to ensure applicants meet the requirements for a liquor license, the requirements for licensure under the Video Gaming Act and have not been convicted of any gambling offense. In addition, all applications shall set forth the number of proposed video gaming terminals to be used within the Village. The permit for terminal operators shall only be valid for those video gaming terminals identified within the application and on the permit. The permit fee shall be five hundred dollars ($500.00) per video gaming terminal used within the Village per year. The application and permit may be amended at any time to add video gaming terminals at a cost of five hundred dollars ($500.00) per video gaming terminal. No video gaming terminal may be utilized at an authorized establishment absent the terminal operator holding a permit from the Village.
   D.   Distributor's Permit: Any person who is a distributor within the Village who manufactures, distributes or supplies video gaming terminals, and who does not have a video gaming terminal operator's permit from the Village, must obtain a distributor's permit. The permit fee for a distributor shall be five hundred dollars ($500.00) per year. Applications for a distributor's permit shall be developed by Village staff to ensure applicants meet the requirements for a liquor license, the requirements for licensure under the Video Gaming Act and have not been convicted of any gambling offense.
