§ 70.48 TOWING OF ILLEGALLY PARKED VEHICLES.
   (A)   When a vehicle is found illegally parked on a town street or right-of-way, public parking lot or other town property in violation of a statute or a parking restriction established by town ordinance, the Town Marshal may direct that the vehicle be towed away under the following circumstances:
      (1)   When a posted sign indicating the parking restriction also specifically states the area is in a tow-in zone; or,
      (2)   When the vehicle is so parked as to cause an actual traffic hazard or obstruction or block the use of driveways or other vehicular entrances or exits; or,
      (3)   When the vehicle is parked so as to prevent or interfere with any of the activities described by § 70.46 (A)(1) through (A)(4); or,
      (4)   When the vehicle prevents or interferes with the operations and activities of authorized emergency vehicles; or,
      (5)   When notice to remove the vehicle has been given by a tag attached to the vehicle in accordance with IC 9-22-1-11 and the vehicle is not so removed within 72 hours thereafter.
   (B)   Vehicles to be towed away pursuant to this section shall be towed and safely stored by a vehicle towing service with which the town has a contract, pursuant to IC 9-22-1-1 et seq., all at the expense of the vehicle owner in accordance with the same towing and storage rates applicable to abandoned vehicles under the contract. However, prior notice before towing pursuant to IC 9-22-1-11 is not required in the case of illegally parked vehicles described by divisions (1) through (5) above. A vehicle towed pursuant to this section may be reclaimed by the owner or the owner's authorized agent upon payment to the vehicle towing service of the applicable towing and storage costs. But if any vehicle towed pursuant to divisions (1) through (5) above is not so reclaimed within 15 days it shall thereafter be deemed and administered as an abandoned vehicle in accordance with IC 9-22-1-1 and Chapter 90 of this code of ordinances.
