(A) The Sebewaing Light and Water Department wires, poles and apparatus, together with any interconnections thereof, are the exclusive property of Sebewaing Light and Water Department, and the connections of a customer's premises thereto does not entitle the customer to any use thereof except as necessary for the delivery of the Sebewaing light and water service to the customer. The use of any part of the Sebewaing light and water distribution or transmission system by the customer for carrying foreign electric currents or carrier current transmission, radio or telephone broadcasting or receiving is expressly prohibited except as provided in Chapter 153.
(B) A pole license agreement providing joint use of certain Sebewaing Light and Water Department wood poles with a servicing Telephone/Communications Company may be entered into. The Village of Sebewaing/Sebewaing Light and Water Department may also enter into a rental agreement with a CATV (community access television) Company providing cable television service to customers within the Sebewaing Light and Water Department service area. The use of any pole by a Telephone/Communications Company or CATV Company without first having entered into a written agreement with the Village of Sebewaing/Sebewaing Light and Water Department is prohibited.
(C) The unauthorized attachment (including painting or marking) of any signs, banners, lines, cables, equipment or any other material to Sebewaing Light and Water Department poles is prohibited. Authorization for poles use may be granted by the Sebewaing Light and Water Superintendent or designated representative based on purposes permitted by Michigan state law and requirements of governmental authority for the safety and welfare of the general public. No pole license agreement for commercial use will be authorized without possession of a valid Sebewaing Light and Water Department issued franchise.

Any Village of Sebewaing employee may remove or cause to be removed without notice any unauthorized foreign matter from its poles at the expense of the customer, the person(s) attaching the unauthorized matter or, in the event neither can be identified, the individual, firm or organization which appears to be the primary sponsor, user or beneficiary of the unauthorized matter. Sebewaing Light and Water Department will observe reasonable precaution to prevent any damage resulting from such removal, but will not be liable for any damage thereto.

Any person, firm or corporation violating any of the provisions of this chapter shall be guilty of a misdemeanor and shall be punishable by a fine of not more than $500, or sentence in the county jail for a period of not more than 90 days, or both a fine and imprisonment at the discretion of the court.
