DRIVE-IN RESTAURANTS
§ 122.01 DEFINITIONS.
   For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   DRIVE-IN RESTAURANT. Any restaurant or eating place where meals, sandwiches, cold drinks, beverages, ice cream or other food is served directly to or is permitted to be consumed by patrons thereof either while in their automobile, motorcycle or other vehicle parked on the premises or while within any portion of the restaurant premises.
   OWNER. The legal owner of the restaurant premises of the lessee or the operator thereof.

§ 122.02 PURPOSE.
   The declared purpose of this subchapter is to preserve the public peace and quiet, health and safety in the use of the premises occupied by drive-in restaurants, including all driveways, parking places and access routes thereto, and to that extent the open space of each of such premises is a public place.

§ 122.03 OWNER TO MAINTAIN ORDER ON PREMISES.
   The owner, lessee or operator of any drive-in restaurant shall maintain peace and quiet and good order upon the premises and shall not permit noise or nuisance upon the parking area or driveways.

§ 122.04 REGULATIONS FOR MOTOR VEHICLES.
   (A)   Stopping or standing within driveways prohibited. No person shall stop, stand or park a vehicle within any driveway.

   (B)   Racing motor or creating loud noise prohibited. No person shall race the motor of any vehicle, nor needlessly and suddenly start or stop a vehicle or sound the horn or cause any loud or needless noise to emit from any vehicle in any drive-in restaurant.

   (C)   Leaving vehicle on premises unattended. No person shall park a vehicle upon the premises of a drive-in restaurant and leave the premises with such vehicle unattended without the consent of the owner or manager of such restaurant.

   (D)   Cruising and racing prohibited. No person shall cruise or race any vehicle in or along any driveway or use as a shortcut to another street any driveway in any drive-in restaurant.

§ 122.05 DISPOSITION OF WASTE MATERIALS.
   No person shall place, deposit or dispose of any food or beverage paper cup or napkin or food container of any kind or any other waste material upon any drive-in restaurant premises or any driveway, parking area or any street or sidewalk adjacent to and abutting upon any drive-in restaurant except in receptacles provided therefor.

§ 122.06 TRASH RECEPTACLES TO BE PROVIDED.
   The owner of any drive-in restaurant shall provide not less than two receptacles sufficient for the deposit of trash, litter, papers, napkins and cups, remnants of food and food containers, each such receptacle to be located conveniently near to each exit to such drive-in restaurant and reasonably available to the patrons thereof.
