1309.18 SUBSTANDARD PREMISES.
(a)    Compliance. All persons shall meet the minimum standards set forth in this section to be in compliance with this Code.
   (b)    Definition. Any building or portion thereof including any dwelling, dwelling unit, rooming house, rooming unit or the premises, as defined in Section 1309.03 (34), on which the same is located, in which there exists any of the following listed conditions to an extent that endangers the health, or safety or welfare of the public or the occupants thereof shall be deemed and hereby is declared to be a substandard building.
   (c)   Inadequate Sanitation. Inadequate sanitation includes, but is not limited to the following:
      (1)    Lack of, or improper water closet, lavatory, bathtub or shower in a dwelling unit.
      (2)    Lack of or improper water closets, lavatories, and bathtubs or showers per number of persons in a boarding or rooming house.
      (3)    Lack of or improper kitchen sink.
      (4)    Lack of hot and cold running water to plumbing fixtures in a dwelling unit or rooming house.
      (5)    Lack of adequate heating facilities.
      (6)    Lack or improper operations of required ventilating equipment.
      (7)    Lack of minimum amounts of light and ventilation required by this Code.
      (8)    Room and space dimensions less than required by this Code.
      (9)    Dampness of habitable rooms.
      (10)    Infestation of insects, vermin or rodents.
      (11)    General dilapidation or improper maintenance.
      (12)    Lack of connection or required sewage disposal system.
            (13)    Improperly enclosed, ventilated or unsanitary under floor area.
            (14)    Lack of adequate garbage and rubbish and removal facilities.
   (d)    Structural Hazards. Structural hazards include but are not limited to the following:
       (1)    Deteriorated or inadequate foundations.
      (2)    Defective or deteriorated flooring or floor supports, porches, stairs, steps and hand railings.
      (3)    Flooring or floor supports of an insufficient size to carry imposed loads with safety.
      (4)    Members of wall partitions or other vertical supports that split, lean, list or buckle due to defective material or deterioration.
      (5)    Members of wall partitions, or other vertical support that are insufficient to carry imposed loads with safety.
      (6)    Members of ceilings, roofs, ceiling and roof supports or other horizontal members which are split, or buckle due to defective material or deterioration.
      (7)    Members of ceilings, roofs, ceiling and roof supports or other horizontal members that are of insufficient size to carry imposed loads with safety.
      (8)    Fireplaces or chimneys which list, bulge or settle, or which are of insufficient size or strength to carry imposed loads with safety.
      (9)    Sidewalks, walks and other paved areas on private property shall be kept in sound condition and good repair.
   
   (e)   Nuisance. Nuisance means any nuisance as defined in Section 1309.12.
         
   (f)   Unfit Dwelling. Unfit dwelling includes any dwelling or dwelling unit for human habitation as defined herein.
   (g)   Hazardous Wiring. Hazardous wiring means all wiring except that which conforms with all applicable laws in effect at the time of installation and which has been maintained in good condition and is being used in a safe manner.
   (h)   Hazardous Plumbing. Hazardous plumbing includes all plumbing except that which does not meet the requirements in Section 1309.14.
   (i)    Hazardous Mechanical Equipment. Hazardous mechanical equipment means all mechanical equipment including vents, except that which has conformed with all applicable laws in effect at the time of installation and which has been maintained in good and safe condition.
   
   (j)    Faulty Weather Protection. Faulty weather protection includes but is not limited to all of the following:
      (1)    Deteriorated, crumbling or loose plaster.
      (2)    Deteriorated or ineffective waterproofing of exterior wall coverings, including lack of paint, or weathering due to lack of paint or other approved protective covering; broken, rotted, split or buckled exterior wall coverings or floor coverings.
      (3)   All gutters and downspouts to be properly maintained in good working order and to direct the flow of water away from the dwelling and any surface that is normally used to enter or exit the dwelling.
   (k)   Fire Hazard. Fire hazard means any building or portion thereof, device, apparatus, equipment, combustible waste or vegetation which in the opinion of the Chief of the Fire Department or his authorized representative, is in such a condition as to cause a fire or explosion or provide a ready fuel to augment the spread and intensity of fire or explosion arising from any cause.
   
   (l)    Faulty Materials of Construction. Faulty materials of construction means materials of construction except those which are specifically allowed or approved by this Code and which have been adequately maintained in good and safe condition.
   (m)    Hazardous or Unsanitary Yard Area. Hazardous or unsanitary yard area means, but is not limited to, those yard areas on which an accumulation of weeds, leaves, vegetation, lumber (new and used), junk, dead organic material, debris, garbage, offal, rat harborage, rubbish, stagnant water, combustible materials, animal wastes, mattresses, rugs, new or old construction materials, vehicle parts, tools, broken, unused or discarded toys, interior household furniture, or other household furnishings, interior plumbing fixtures, appliances, or other items customarily found or used on the interior of a home or similar materials or conditions which constitute fire, health or safety hazards.
             (1)   Parking of Vehicles: Parking spaces at residential locations are not permitted on the front yard area as defined in Section 1135.01 (a)(68) of this Code which is immediately in front of the dwelling/dwelling unit. This Section shall not apply to the parking of vehicles on the front yard if the vehicle(s) are parked on existing original driveways, with or without an existing garage. Existing original driveway shall be defined as those driveways put into place at the time of the construction of the existing or prior main building on any City lot or those driveways subsequently approved by the City through ordinance or other means. Residential parking must be done on a properly installed driveway or parking area improved with acceptable material, as described in Salem Zoning Code Section 1199.04 (a), to provide a dust free and durable surface.
       (2)    Sale of used Motor Vehicles: No person, firm or corporation shall display for sale a used motor vehicle, boat or recreational vehicle in the yard area of a residential property except that such provision shall not apply in the following specific instances:
         A.    One used motor vehicle, boat or recreational vehicle may be displayed for sale one time each calendar year for a period of time not to exceed two weeks if such motor vehicle, boat or recreational vehicle is titled in the name of an occupant of the property. The occupant of the property is limited to one such display of either a used motor vehicle, boat or recreational vehicle each year.
         B.    Such used motor vehicles are displayed by duly and proper licensed automobile dealers and such display occurs in areas properly zoned to conduct such a business.
            (3)    Junk or Abandoned Vehicles: Complaints of junk or abandoned vehicles pursuant to Section 303.10 of the Codified Ordinances will be investigated to determine if a violation exists. When a violation is found to exist a period of ten (10) days will be allowed to remove the vehicle from the premises. When a violation exists past the ten (10) day period, the violation will be forwarded to the Salem Police Department for further action.
      (4)    Cutting Required: No property owner and/or agent shall refuse or neglect to cut grass or weeds when the grass or weeds have reached a height of eight (8) inches.
      (5)    Only furniture specifically designed for outdoor use is permitted in the exterior area of a dwelling.
   (n)   Inadequate Exits. Inadequate exits means all buildings or portions thereof not provided with adequate exit facilities as required by this Code except those buildings or portions thereof whose exit facilities conformed with all applicable laws at the time of their construction and which have been adequately increased in relation to any increase in occupant load, alteration or addition, or any change in occupancy.
   (o)    Inadequate Fire Protection of Fire Fighting Equipment. There is inadequate fire protection or fire fighting equipment in all buildings or portions thereof which are not provided with the fire resistive construction or fire extinguishing systems or equipment required by this Code except those buildings or portions thereof which conformed with all applicable laws at the time of their construction and whose fire resistive integrity and fire extinguishing systems or equipment have been adequately maintained and improved in relation to any increase in occupant load, alteration or addition, or any change in occupancy.
 
     (p)    Improper Occupancy. Improper occupancy means all buildings or portions thereof occupied for living, sleeping, cooking or eating purposes which were not designed or intended to be used for such occupants.
