A. Regulations Adopted: Section 6, "Municipal Drainage", of the rules and regulations set forth by the Buffalo-Red River watershed district is hereby adopted by reference. Said regulations are attached to ordinance 16-B. (Ord. 16-B, 7-18-2000; amd. 2005 Code)
B. Yard Grading Plan: No person shall construct or grade a yard within the city without first submitting his plan to the city council. The city engineer may be consulted to establish the necessary grades so as to provide adequate drainage.
C. Permission To Grade Required; Regrading: If any person hereafter constructs or grades or regrades his yard without first having obtained permission from the city council, such person shall be obligated to regrade the lot in accordance with the grade established by the city engineer.
D. Rainwater And Sump Pump Flows: No person shall divert rainwater from his property in such a manner as to cause it to flow into an adjacent property. Sump pump discharge water shall be directed into normal drainage flows.
E. Drainage Problems; Petition For Corrective Action: In residential areas where drainage problems exist, a majority of the affected property owners may petition the city council for corrective action. Upon receipt of said petition, the city engineer shall make a survey and prepare a plan cost estimate and submit it to the council. If the council determines that the plan is feasible, it shall order the project completed and the entire cost, including engineering and administrative costs, assessed against the properties in accordance with Minnesota state law and the ordinances and regulations of the city.
