153.05 ORGANIZATION, QUORUM AND REPORTS.
   (a)    The Street Tree Commission shall choose its own officers, make its own rules and regulations and keep a journal of its proceedings. A majority of the members shall be a quorum for the transaction of business. All plans, findings, advice, reports and recommendations made by the Commission shall be in writing and shall designate by name those members of the Commission approving or concurring therein. Members who do not so approve or concur therein shall have the right, as a part of such report, to state their reasons for refusing to approve or concur.
   (b)    The Commission, when requested by Council, the Mayor or the City Administrator, shall consider, investigate, make findings, report and recommend upon any special matter or question coming within the scope of its work.

153.06 LIST OF UNDESIRABLE AND DESIRABLE TREES, SHRUBS AND FLOWERS.
   The Street Tree Commission shall prepare lists of trees undesirable for planting in public places in the City so as to insure the public safety and welfare. These shall not be recommended for general planting and their use, if any, shall be restricted to special locations in public places where, because of certain characteristics of adaptability or landscape effect, they can be used to advantage. The Commission shall prepare lists of trees desirable for planting in public places. Other species and varieties may be added or deleted as experience proves their value. The selection of trees, shrubs and flowers species for planting on public places shall follow the recommendation of the Commission.

153.07 TREE SURVEYS; MASTER STREET TREE PLAN.
   (a)    The Commission shall have the authority and it shall be its duty to conduct tree surveys and prepare a Master Street Tree Plan for all trees, shrubs and flowers in or upon all public places which, in its opinion, effectuate the provisions of this chapter. Such Plan shall not become effective until approved by Council.
   (b)    The Street Tree Commission shall keep updated from time to time the Master Street Tree Plan after its adoption by Council.

153.08 TREE WORK; PERMIT REQUIRED.
   No person shall remove, destroy, cut, break, climb or injure any tree existing on any public place in the City or authorize or procure any person to do so, or remove or tamper with any device placed for the protection of any such tree, or attach any permanent rope, wire, chain, sign or other device either to such tree or to any device placed for the protection of such tree, or authorize or cause the same to be done or plant a tree in such place, without first obtaining written permission from the City Administrator.

153.09 DELETERIOUS AND IMPERVIOUS SUBSTANCES; BUILDING OPERATIONS; INTERFERENCE WITH SUPERINTENDENT; PENETRATION OF ROOTS.
   (a)    No person shall permit any natural or artificial gas, salt, brine, water, oil, liquid dye or any other substances deleterious to trees to come in contact with the soil surrounding the roots of any tree upon any public place in the City in such a manner as to kill, injure, deface, destroy or affect the growth of such tree.
   (b)    No person shall place or maintain upon the ground in any public place any stone, concrete, brick or other impervious material or substance in such a manner as may obstruct the free access of air and water to the roots of any tree upon any public place without first having obtained written permission from the City Administrator. Unless otherwise provided for, there shall be maintained about the base of the trunk of each such tree at least nine square feet of open ground for a tree three inches in diameter, and for every two inches of increase in such diameter there shall be an increase of at least one square foot of open ground.
   (c)    No person in charge of or responsible for the erection, alteration or removal of any building or structure in the City shall permit such operations in the vicinity of any tree without a good and sufficient guard or protection as shall prevent injury, damage or defacement to such tree arising out of, in connection with, or by reason of, such operation. The quality and location of the guard or protection shall be determined by the City Administrator.
   (d)    No person shall interfere with anyone who is engaged in or about the carrying out of the provisions of this chapter or the doing of any of the work ordered by the City Administrator to be done hereunder.
   (e)    Any tree upon private property in the City, in such close proximity to any public place in the City as will permit the roots of such tree to penetrate through or under the surface of any public place, excluding sidewalks, in the City, is hereby declared to be a public nuisance and may be abated forthwith by the City Administrator.
