6-8-2: USE OF LASER POINTERS IN PLACES OF PUBLIC ASSEMBLY:
   A.   Definitions. For the purposes of this section, the following words and phrases shall have the meanings ascribed to them by this subsection:
   LASER POINTER: A helium neon (HeNe) laser which operates at a wavelength of 632.8 nMe with the mandated power limit of 5mW; a diode laser which operates at a wavelength of 670 nMe with a power source providing 5mW; and any other laser pen, laser pointer or similar device which emits lasers or beams of light.
   PLACE OF ASSEMBLY: A sports arena, concert hall, theater, movie theater, exposition center, trade show facility, exhibition hall, ballroom, and any other structure or places which are used or intended for use as locations for entertainment, sporting events, lectures, concerts, plays, dances and similar events, productions and performances. Places of public assembly shall include, but not be limited to, the Allstate Arena, the Rosemont Theater, the Donald E. Stephens Convention Center, Impact Field, and the Dome and Ballpark at Rosemont.
   UNAUTHORIZED PERSON: Any person who does not have permission from the owner or operator of a place of assembly or from the producer or performer of an event occurring in a place of public assembly to use a laser pointer in the place of assembly.
   B.   Prohibition: It shall be unlawful for any unauthorized person to use, display, point or shine a laser pointer in a place of assembly.
   C.   Penalties:
      1.   Any unauthorized person who uses a laser pointer in violation of the provisions of subsection B of this section will be subject to removal from the place of assembly and, in addition, shall be subject to a fine of not less than two hundred fifty dollars ($250.00) nor more than seven hundred fifty dollars ($750.00) for each offense.
      2.   Each instance of the use of a laser pointer in violation of subsection B of this section shall constitute a separate offense.
      3.   Any laser pointer used in violation of subsection B of this section shall constitute contraband and shall be subject to confiscation by the Department of Public Safety.
