§ 52.02 SANITARY SEWER CONNECTIONS MANDATORY.
   (A)   Any person who uses any building for human occupancy, employment, recreation or is otherwise required to have toilet facilities under the Oregon Uniform Building Code within the City of Rockaway Beach, shall connect his or her houses and structures requiring sanitary sewage disposal with the street sewers of the City of Rockaway Beach sanitary sewer system; the time within which connections shall be made shall be determined by the Council, and due notices to the property owners of the connection date given by certified mail.
   (B)   All structures constructed after completion of the sanitary system will likewise be connected to the sanitary sewer system. In situations where connection to the sanitary sewer system may not be possible or feasible due to the location of the structure, the decision as to whether or not the structure shall be connected with the sanitary sewer system shall be within the purview of the Council; and the final decision shall emanate therefrom.
      (1)   It shall be unlawful for any person to place, deposit or permit to be deposited in any unsanitary manner upon public or private property within the City of Rockaway Beach or in any area under the jurisdiction of the city, any human or animal excretion, garbage or other objectionable waste.
      (2)   Any person who uses any building for human occupancy, employment, recreation or is otherwise required to have toilet facilities under the Oregon Uniform Building Code situated within the City of Rockaway Beach and abutting on any street, alley or right-of-way in which there is located or may in the future be located a sanitary sewer of the City of Rockaway Beach, is hereby required at his or her expense to install suitable toilet facilities therein and to connect the facilities directly with the sewer system in accordance with the provisions of this chapter within 90 days after date of official notice to do so, provided the sewer is within 200 feet of the property line. It shall be the duty of the user to make application to the city, pay the fees as prescribed by the city and complete the sewer connection within 90 days from the date of the notice, unless the City Council shall, in writing, extend the time for the completion of the connection.
