6-3-4: PRIVATE WASTE DISPOSAL:
   A.   License Required; Fees: No person operating as a waste disposal firm or otherwise, unless contracting directly with the Village as its waste disposal contractor, or except as otherwise provided in this Chapter, shall remove building materials, garbage, refuse or recyclables from any premises in the Village or transport such through the streets, alleys or public ways of the Village, or dump, incinerate or in any other manner dispose of waste originating in the limits of the Village, or contract for or permit himself to be employed or engaged for any such removal, transportation or disposal, without first having secured a license for performing such disposal service from the Village Clerk. See Chapter 3 of Title 3 relating to the required license. (Ord. 2454, 9-23-1991; amd. Ord. 2668, 2-12-1996)
   B.   Licensing - Additional Information: In addition to the normal information required of any applicant for a business license, any applicant for a waste disposal firm's license shall provide the following information:
The name of the person to be licensed, or in the case of a corporation, the names of the principal officers, together with the business and home addresses and telephone numbers of each such person; description of the equipment to be used in such collection, transportation and disposal; the list by name and address of persons for whom such removal is made; the specifications of the vehicle in which the waste is to be transported; the site location of and the manner in which the ultimate disposition of the waste is to be accomplished; a complete written description of the solid waste collection program which the licensee offers to its customers. Also as a condition of maintaining a waste disposal firm's license, the licensee shall submit quarterly reports summarizing solid waste activities on forms furnished by the Director of Public Works. All quarterly report information as well as lists of facilities served shall be considered proprietary information and shall not be made available to the general public.
All collection equipment operated in the Village shall be identified with the name and telephone number of the licensee clearly and permanently shown.
All waste disposal firms desiring to engage in the business of collection of garbage and refuse shall also offer to its customers a comprehensive recyclables collection program to include as a minimum all materials currently being collected by the Village. Further, any waste disposal firm servicing a multi-family property is hereby required to provide a recycling program in accordance with subsection 6-3-4C of this Chapter. (Ord. 2668, 2-12-1996)
   C.   On-Site Multi-Family Structure Recycling Program:
      1.   Program requirements:
         a.   All "multi-family properties", as defined in Section 6-3-1 of this Chapter, shall be required to institute an on-site recycling program, with collection of recyclables to be no less than one pickup per week.
         b.   Said program shall be instituted by a multi-family property on or before September 1, 1995.
         c.   Multi-family property owners may contract for recycling and refuse services with a private waste disposal firm, duly licensed by the Village. Multi-family property owners shall be billed for recycling and refuse services directly by the private waste disposal firm.
         d.   An acceptable recycling program shall include, but is not limited to, the following components:
            (1)   Siting and design of common area collection areas for recyclables;
            (2)   Recyclable materials collection;
            (3)   Provision of common area recycling containers;
            (4)   Data collection and reporting;
            (5)   Educational campaign and materials; and
            (6)   Recycling program administration and maintenance.
      2.   Specific Requirements:
         a.   Recycling collection areas for residents shall be conveniently located and maintained within common areas in or near the buildings, and consist of separate containers for the purpose of temporary storage of recyclables. Whenever possible, recycling containers should be placed adjacent to common area solid waste collection containers.
         b.   Indoor common area collection/storage areas shall be established in accordance with appropriate Village fire and/or safety codes.
         c.   Exterior recyclables storage areas shall be established in accordance with Village requirements for solid waste enclosures.
         d.   The multi-family property owner shall maintain all recycling areas, including the containers, in a clean, sanitary, and litter-free manner.
         e.   On-site multi-family structure recycling programs are required to offer collection of a minimum of five of the following types of recyclables:
corrugated cardboard
telephone books
magazines and catalogs
high-grade paper
aluminum, steel, tin and bi-metal cans
PETE (#1) and HDPE (#2) plastic bottles
newspaper
chipboard
"junk" mail
glass bottles (three colors)
         f.   Recyclables must be source separated from other solid waste prior to collection for the purpose of recycling such materials. Separate collection containers and collection vehicles shall be employed.
         g.   The minimum gallon amount of recycling container capacity (total weekly base recycling container capacity) an owner shall provide weekly for each structure shall be based on the following formula:
7 gallons x number of studio and 1-bedroom units, +
8 gallons x number of 2-bedroom units, +
9 gallons x number of 3-bedroom or more units
= total base weekly recycling container capacity.
The weekly base recycling container capacity may be met by a combination of container sizes and number of pick- ups, such as containers totaling half the base capacity picked up twice a week. Capacity per structure may be shifted within the multi-family property if necessary, so long as the total required capacity is met.
         h.   The licensed waste disposal firm providing the on-site recycling collection service shall be responsible for furnishing, maintaining, and replacing all common area recycling containers and collection vehicles which are deemed necessary in the recycling program. The waste disposal firm shall be responsible for the collection, intermediate storage or transfer, transportation, and sale of recyclable materials to a processor, broker, or market desired for reuse of materials.
         i.   Multi-family property owners shall notify residents of the availability of recycling services through a formal and ongoing educational campaign, and shall use their best efforts to gain and maintain participation in the program.
         j.   It shall be unlawful for any unauthorized persons to remove or damage any recyclable materials placed in designated containers, or the containers themselves. Title to recyclable material shall pass to the private waste disposal firm when the materials are placed into the collection vehicle.
   D.   Recyclables Collection Requirements For Private Waste Disposal Firms:
      1.   Waste Disposal Firm License: All private waste disposal firms desiring to receive a waste disposal firm license to collect solid waste, compostable material and/or recyclable material from multi-family properties in the Village must comply with all applicable Federal, State, County and local laws, ordinances, rules and regulations. As a condition of receiving, renewing and maintaining a waste disposal firm license to collect solid waste, compostable material and/or recyclable material from multi-family properties within the Village, each licensee or applicant for such license shall:
         a.   Obtain all permits and licenses required by Federal, State and County laws, ordinances, rules and regulations and maintain the same in full force and effect.
         b.   Submit to the Village a list of the multi-family properties it serves within the Village's jurisdiction.
         c.   Provide collection and recycling services for any multi- family property owner that requests such services in accordance with the on-site multi-family structure recycling program requirements set forth above.
         d.   Failure to comply with the above provisions shall result in a denial of receiving, renewing or maintaining a waste disposal firm license until such time as the applicant complies with all provisions set forth in this Section.
      2.   Reporting Requirements:
         a.   Each licensed private waste disposal firm shall submit a quarterly report to both the multi-family property owner(s) or their designee and the Village and/or its designee that contains the following information:
            (1)   Total weight or volume of refuse collected from multi- family properties it serves within the Village.
            (2)   Total weight or volume of yard waste collected from multi- family properties it serves within the Village.
            (3)   Total weight or volume of recyclable materials collected from multi-family properties it serves within the Village.
            (4)   A summary of recycling services provided to each multi- family property, to be submitted only on an annual basis with the fourth quarter report.
         b.   Quarterly reports submitted to the multi-family property by the licensed waste disposal firm shall only pertain to that property's activity.
         c.   Quarterly reports submitted to the village shall contain aggregate totals concerning the information listed above for all multi-family properties the licensed private waste disposal firm serves within the village's jurisdiction.
         d.   Reports shall be due no later than fifteen days after the close of each quarter. Quarters are defined as follows: First quarter - January 1 through March 31; second quarter - April 1 through June 30; third quarter - July 1 through September 30; and, fourth quarter - October 1 through December 31. Reports shall follow the format prescribed by the village.
         e.   The information shall be considered exempt from the Illinois freedom of information act 1 disclosure by the village or its designee upon assertion as to its proprietary nature by the licensed private waste disposal firm. The village or its designee shall only report the information in the form of statistics and/or volume totals for all multi-family properties in the village. No specific information on individual licenses shall be divulged.
         f.   The village and/or its designee shall have the right to inspect and examine the licensed private waste disposal firm's records pertaining to the collection and disposal or processing of refuse and recyclables upon request and with reasonable notice. The village or its designee shall further have the right to require the reporting of other data or information relative to the recycling program from time to time.
         g.   All such reports, data, and information once received by the village or its designee shall become the property of the village to be used as it shall determine without obligation to any person, firm or corporation.
         h.   Failure to submit any required report to the village or its designee shall be grounds for revocation of the business license and/or franchise agreement until such time as the licensed private waste disposal firm or franchised hauler complies with the requirements set forth in this section.
      3.   Implementation And Continuation Of Program Required:
         a.   Implementation of on site multi-family structure recycling programs shall be required as stated in subsection C1b of this section. Such recycling programs shall be maintained in effect regardless of any change of building ownership or private waste disposal firm. Multi-family property owners shall be required to notify the village in writing within thirty days after a change in their choice of waste disposal firm. (Ord. 2612, 8-29-1994; amd.
