§ 165.096 INSTITUTIONAL (IS) DISTRICT.
   (A)   IS District intent, permitted uses and special exception uses.
      (1)   District intent. The IS (Institutional) District is intended to be used as follows.
         (a)   Use type and intensity. Varying intensity institutionally owned lands, including state, county and city facilities.
         (b)   Application of IS District.
            1.   Existing and new development;
            2.   Buffer district or transitional zoning district; and
            3.   Small area zoning.
         (c)   Development standards. Require quality time, place and manner development standards to minimize impacts on adjacent residential properties while serving the needs of the overall community.
         (d)   Appropriate adjacent zoning districts. PR, AG, R1, R2, R3, UR, M1, M2, MP, UV, IS, NC, LC, GC, OC, CB, HC, EP, IC, I1 and I2.
         (e)   Plan Commission. Use the IS District for existing developments and carefully for new institutional development.
         (f)   Board of Zoning Appeals. Allow a special exception use only when it is compatible with the surrounding areas.
      (2)   Permitted uses.
         (a)   Accessory permitted uses. Small wind turbine system.
         (b)   Commercial permitted uses.
            1.   Commercial training facility or school;
            2.   Farmer’s market;
            3.   Seasonal attraction; and
            4.   Swimming pool.
         (c)   Industrial permitted uses.
            1.   Sewage treatment plant; and
            2.   Water treatment plant.
         (d)   Institutional Permitted Uses
            1.   Airport, public;
            2.   Bus station;
            3.   Camp;
            4.   Cemetery/mausoleum;
            5.   Child care institution;
            6.   Church, temple or mosque;
            7.   Community center;
            8.   Government office;
            9.   Government operations (non-office);
            10.   Heliport, public;
            11.   Hospital;
            12.   Library;
            13.   Museum;
            14.   Nature center;
            15.   Police or fire station;
            16.   Pool, public;
            17.   Post office;
            18.   Rescue station ;
            19.   Retreat center;
            20.   School (P-12); and
            21.   Trade or business school.
         (e)   Residential permitted uses.
            1.   Assisted living facility;
            2.   Fair housing facility (large);
            3.   Fair housing facility (small); and
            4.   Nursing home.
      (3)   Special exception uses.
         (a)   Accessory special exception uses. Large wind turbine system.
         (b)   Industrial special exception uses. Telecommunication facility.
         (c)   Institutional special exception uses.
            1.   Composting facility, public;
            2.   Crematory;
            3.   Jail;
            4.   Recycling collection point;
            5.   Sports complex; and
            6.   Stadium.

   (B)   IS District development standards.
      (1)   Lots.
 
         (a)   Minimum lot area. N/A.
         (b)   Minimum lot width. N/A.
         (c)   Sewer and water. Sanitary sewer and water utility required.
      (2)   Setbacks.
 
         (a)   Minimum front yard setback. Thirty feet for primary and accessory structures.
         (b)   Minimum side yard setback. Ten feet for primary and accessory structures.
         (c)   Minimum rear yard setback. Twenty feet for primary and accessory structures.
      (3)   Lot coverage.
 
         (a)   Maximum lot coverage. Seventy percent of lot area.
         (b)   Minimum main floor area. One thousand square feet.
         (c)   Maximum primary structures. No limit.
      (4)   Maximum structure height.
 
         (a)   Sixty feet for primary structure; and
         (b)   Thirty feet for accessory structure.
