   1376.01 MAINTENANCE RESPONSIBILITIES.
   (a)    Compliance Required. No owner, operator or agent shall occupy, rent or lease, or offer for rental or lease, any business structure or any part thereof which does not comply with the provisions of this Business Maintenance Code.
   (b)    Owner. The owner of every building or structure, or his authorized agent, shall be responsible for maintaining in a clean, safe and sanitary condition the shared or common areas of the premises, including all yard areas, walks, driveways and parkway lots.
   (c)    Occupant. The occupant of any building or structure shall be responsible for maintaining in a clean, safe and sanitary condition that part of the premises which he occupies and controls.

   1376.02 GENERAL MAINTENANCE REQUIREMENTS.
   (a)    All structures and all parts thereof, both exterior and interior, shall be maintained in good repair and shall be capable of performing the function for which such structure or part of any feature thereof was designed or intended to be used.
   (b)    All equipment and facilities appurtenant to a structure shall be maintained in good and safe working order.

   1376.03 MAINTENANCE OF FOUNDATIONS.
   (a)    All foundations of every structure shall be maintained structurally sound and in good repair.
   (b)    All foundations of every structure shall be maintained in such condition as to prevent seepage or leakage of water into the space enclosed within such foundations.
   (c)    All openings into the foundations of every structure shall be protected against the entrance of rodents.
   (d)    Where parts of structures supported on masonry piers, foundations or footers require substantial repair or replacement due to sagging, settling or failure of such support, the same shall be replaced with a foundation conforming to the provisions of Part Thirteen - Building Code.

   1376.04 MAINTENANCE OF ROOFS, GUTTERS AND DOWNSPOUTS.
   All roofs of every structure shall be maintained weathertight and shall be equipped with gutters and downspouts maintained in good repair and connected to a public storm sewer or to an approved retention system.

   1376.05 MAINTENANCE OF EXTERIORS.
   (a)    All exterior walls of every structure shall be maintained weathertight and shall be maintained so as to resist decay or deterioration from any cause.
   (b)    Any structure or secondary or appurtenant structure whose exterior surface is bare, deteriorated, ramshackle, tumble-down, decaying, disintegrating or in poor repair shall be repaired, replaced or razed as follows:
      (1)    All buckled, rotted or decayed walls, doors, windows, porches, floors, steps, railings, soffits, posts, sills, trim and their missing members shall be replaced and put in good condition.
      (2)    All replacements shall match and conform to original design or be replaced completely with a design acceptable to the Building Commissioner and drawings and plans for such replacements reviewed by the Architectural Board of Review as required by Chapter 154 of these Codified Ordinances.
      (3)    All exterior wood or exterior unfinished surfaces, except masonry, shall be sealed and painted, or the surface covered with other approved protective coating or treated to prevent rot and decay, and conform and match the existing paint or surface covering and original design or replacement thereof. All exterior walls and surfaces shall be properly protected against the weather, where such are defective or lack weather protection, including lack of paint or surface covering, or have weathered due to lack of proper protective covering.
   (c)    Any structure, including all secondary or appurtenant structures, awnings and signs, whose exterior is deteriorated, decaying, disintegrating or whose surface is weathered with dirt and grime or has been impaired through peeling or flaking of the paint or other protective coating, shall be repaired, repainted, resurfaced or replaced as follows:
      (1)    All exterior surfaces shall be replaced or repaired in good condition preparatory to repainting or coating.
      (2)    All bare exterior surfaces which are flaking or crumbling shall be replaced or sealed in a good and workmanlike manner.
      (3)    All new or repaired bare surfaces shall be painted or coated.

   1376.06 MAINTENANCE OF INTERIOR WALLS, FLOORS AND CEILINGS.
   (a)    All interior walls, floors and ceilings of every structure used for business purposes shall be maintained free of holes, large cracks and any loose or deteriorated material, and shall have a sealing coating of paint, wallpaper or other substance located thereon, and maintained in a clean and proper condition.
   (b)    The floors of all toilet rooms shall have a cove base at all walls and partitions. Floor surfaces and cove base shall be of nonabsorbent materials with moisture-resistant joints, and shall be kept in a sanitary and clean condition.

   1376.07 EXTERIOR AND INTERIOR PROPERTY AREAS.
   (a)    Exterior Property Areas. No owner, agent or occupant of any premises shall maintain or permit to be maintained at or on the exterior property areas of such premises any condition which deteriorates or debases the appearance of the neighborhood, reduces property values in the neighborhood, creates a fire, safety or health hazard or which is a public nuisance, including, but not limited to, any of the following:
      (1)    Broken or dilapidated fences, walls or other structures;
      (2)    Improperly installed or maintained public sidewalks, walks, driveways and driveway aprons, which are in a defective condition in any of the following listed particulars:
         A.    Any block having multiple cracks or any single crack larger than one-half inch wide;
         B.    Adjoining sections of block, or a portion thereof, whose edges differ vertically by one inch or more;
         C.    Blocks having a transverse slope in excess of one inch per horizontal foot toward the street;
         D.    Blocks having a reverse slope that impound water to a depth of one-half inch or more; (Slope toward property. )
         E.    Blocks having depressions that impound water to a depth of one inch or more; or
         F.    Blocks having disintegrated or deteriorated areas.
   It is further provided that every public sidewalk shall be concrete or stone slab.
      (3)    Out-of-use or nonusable appliances, dilapidated automobiles or automobile parts; or
      (4)    Rugs, rags or other materials hung on lines or in other places on such premises, which materials are not being used for general household or housekeeping purposes; broken, dilapidated or unusable furniture, mattresses or other household furnishings; plastic materials, paints, miscellaneous coverings and/or any other materials, including those described in this section, placed at or on the premises in such a manner as to be patently unsightly, grotesque or offensive to the senses.
   (b)   Exterior Property Areas. Interior property areas of all premises shall be kept free of any debris, object, material or condition which creates a health, accident or fire hazard.
   (c)    Parking Lots in Commercial Areas. 
      (1)    Asphalt or concrete parking lots shall be kept in a safe condition, free from chuck holes, depressions or large cracks.
      (2)    If such parking lots are found to be in need of repair, the Building Commissioner shall cause a written certified notice to be sent to the owner of such property requiring resurfacing for all or any part thereof.
      (3)    The notice shall set forth the amount of time for compliance and shall be determined by the Commissioner considering the extent of repair, cost of repair and prevailing weather conditions, but in no event less than thirty days nor more than ninety days.

   (d)    Concrete or Asphalt Driveway Aprons. 
      (1)    Concrete or asphalt driveway aprons shall be kept in a safe condition, free from chuckholes, depressions or large cracks. Any such driveway aprons which are in need of repair or constitute a dangerous condition to the public using the same, shall be replaced with concrete.
      (2)    If such parking lots are found to be in need of repair, the Building Commissioner shall cause a written certified notice to be sent to the owner of such property requiring resurfacing for all or any part thereof.
      (3)    The notice shall set forth the amount of time for compliance and shall be determined by the Commissioner considering the extent of repair, cost of repair and prevailing weather conditions, but in no event less than thirty days nor more than ninety days.

   (e)    Parking Lot Maintenance. 
      (1)    Parking lots shall be kept in a clean, sanitary condition, free from scrap paper and miscellaneous debris.
      (2)    Such containers as are required for debris shall be installed.
      (3)    Landscaping shall be kept in good condition and appearance, and grass, weeds and other growth kept to a minimum of six inches.
