2-1-10: VEHICLE RESTRICTIONS IN PARK OR CEMETERY, ON PUBLIC WAYS:
   A.   Park And Cemetery Restrictions:
      1.   No person may operate an automobile, motorbike, motor truck, motor delivery wagon, bus, motorcycle, minibus, minibike, snowmobile or other similar motor vehicle, trailer or semitrailer used in connection therewith in any village park or cemetery unless an area in such park or cemetery has been specifically designated by the village board for usage of a vehicle. The village board may limit the type of vehicle which may be operated in any park or cemetery area.
      2.   This subsection shall not apply to:
         a.   Any vehicle owned by the state, the United States or a local unit of government or any vehicle operated by employees, agents or officers of the state, the United States or of a local unit of government while in the performance of their official duties.
         b.   Any vehicle, when furnishing services or supplies.
         c.   Any vehicle traveling on the designated vehicular roads in the parks or cemeteries of the village.
      3.   Any person violating subsection A1 of this section shall forfeit not more than one hundred dollars ($100.00) for each offense. (Ord., 6-19-1978)
   B.   Snowmobile Requirements: Except as otherwise specifically provided in this subsection, the statutory provisions describing and defining regulations with respect to snowmobiles in the following enumerated sections of the Wisconsin statutes, are hereby adopted by reference and made part of this subsection as if fully set forth herein. Acts required to be performed or prohibited by such statutes are required or prohibited by this subsection. Any future amendments, revisions or modifications of the statutes incorporated herein by reference are intended to be made part of this code. For purposes of this subsection, "village" is the village of Reedsville, Manitowoc County, Wisconsin.

      1.   Speed And Equipment:
         a.   Speed: Except as provided by Wisconsin statutes incorporated herein by reference, no person shall operate a snowmobile within the village of Reedsville or on any trail or street or other public way designated in this subsection at a speed in excess of fifteen (15) miles per hour.
         b.   Restriction On Equipment: No snowmobile shall be allowed to operate within the village snowmobile route equipped with an expansion chamber or any muffler other than a properly functioning muffler of the type and size provided by the manufacturer, unless it conforms to the noise level regulated by section 350.095, Wisconsin statutes.
         c.   Headlamp: Every snowmobile operating within the village shall display a lighted headlamp and taillamp at all times. Said lamps shall conform to the requirements of section 350.09, Wisconsin statutes.
      2.   Unattended Vehicles: No person shall leave or allow a snowmobile owned or operated by such person to remain unattended on any public highway or public property within the village while the motor is running or with the starting key left in the ignition.
      3.   Operation On Sidewalks Prohibited: No person shall operate a snowmobile upon any sidewalk, pedestrianway or upon the area between the sidewalk and the curb line of any street in the village, except as specifically authorized for the purpose of legally crossing the street, to obtain immediate access to an authorized area of operation.
      4.   Restrictions On Operators Of Snowmobiles: Operation by youthful operators shall be pursuant to chapter 350.05, Wisconsin statutes.
      5.   Snowmobile Routes And Trails Designated:
         a.   Operation Prohibited In Certain Areas:
            (1)   No person may operate a snowmobile for any reason on the following streets:
               (A)   That portion of State Highway 10 within the village limits.
               (B)   That portion of County Road W within the village limits.
               (C)   Any street within the village limits where operation is prohibited by a posted sign.
            (2)   No person may operate a snowmobile in the following areas within the village, unless authorization is obtained from the village board:
               (A)   Any village parks.
               (B)   Any village cemeteries.
               (C)   Any property owned or leased by the village.
         b.   Snowmobile Routes Are Designated As Follows:
            (1)   Trail Markers: The street superintendent of the village of Reedsville is directed and authorized to procure, erect and maintain appropriate snowmobile route, trail and limit signs and markers as approved by the state department of natural resources and department of transportation under section 350.13, Wisconsin statutes.
            (2)   Trail Status: The local snowmobile club shall have the power to declare the stated snowmobile routes and trails either open or closed.
            (3)   Markers To Be Obeyed: No person shall fail to obey any route or trail sign, marker or limit erected in accordance with this subsection or traffic sign or signal under authority of Wisconsin statutes.
      6.   Snowmobile Travel Within The Village Limits:
         a.   Statutory Authority: Section 350.18, Wisconsin statutes, allows the village to enact local regulations allowing snowmobilers to travel for purposes of residential access and access from a place of lodging.
         b.   Travel By Shortest Route: Operation of snowmobiles within the village limits shall be strictly limited to traveling along the extreme right side of village streets, to gain access to and from the nearest access to a snowmobile route or trail. The authority to enact local snowmobile residential access regulations is found in the Wisconsin statutes. By authority of section 350.18, Wisconsin statutes the village of Reedsville does hereby provide for snowmobile access into residential areas, and to lodging establishments within the village limits according to the guidelines set herein.
         c.   Operation Authorized: This subsection allows the operation of a snowmobile on a roadway and/or shoulder of a street or highway by persons residing in or staying at a residence or lodging establishment within the limits of the village of Reedsville, Manitowoc County, Wisconsin, for the sole purpose of traveling into or from the village by the shortest distance that is necessary to reach the snowmobile trail or route that is closest to that residence or business establishment.
         d.   Conditions: This subsection designates the roadways and/or shoulders of specific streets and highways for snowmobile travel by persons residing in the village, for access to residences or lodging within the limits of the village of Reedsville, Manitowoc County, Wisconsin, to travel for the shortest distance that is necessary to reach the snowmobile trail or route that is closest to that residence or lodging establishment subject to the following conditions:
            (1)   Roadway Travel: Snowmobiles shall be operated on the extreme right side of the roadway and travel with the flow of traffic.
            (2)   Lamps: Snowmobiles shall be operated in single file with headlamps and taillamps in operation at all times, day or night.
            (3)   Yield Right Of Way: Snowmobile operators shall yield the right of way to all other vehicular traffic and pedestrians.
            (4)   Penalty: Snowmobiles violating any of the above conditions will be subject to the penalties outlined in Wisconsin statutes and village ordinance.
            (5)   Speed: A snowmobile operated on any portion of the roadway or shoulder of a highway pursuant to this subsection shall observe the fifteen (15) mile per hour speed limit unless a lower speed is required by Wisconsin statutes.
      7.   Penalty: The penalties under 350.11, Wisconsin statutes are adopted and incorporated herein by reference.
      8.   Enforcement:
         a.   Enforced By: This subsection shall be enforced by any law enforcement officer of the village of Reedsville, Manitowoc County, Wisconsin, or such other local, county or state law enforcement officers as authorized by the village board or by Wisconsin statutes.
         b.   Uniform Traffic Citation: The uniform traffic citation promulgated under the Wisconsin state statutes, shall be used for violations of this subsection relating to highway use except as herein provided.
         c.   Parking Violations: The special standardized village parking ticket, if any, shall be used for enforcement of violations of rules of the road relating to parking of vehicles.
         d.   Other Violations: All violations of this subsection not described in subsection B8b or B8c of this section shall be enforced in accordance with Wisconsin statutes. Stipulations of guilt or no contest may be made as provided in Wisconsin statutes in substantially the form provided in the uniform traffic citation within five (5) days of the date of the citation for such violation.
         e.   Forfeited Penalties And Deposits: Except as otherwise provided in Wisconsin statutes and the deposit schedule adopted by the state board of circuit court judges hereunder, required penalties and deposits not including costs or fees for violation of this subsection shall be as established by the schedule adopted by the village of Reedsville village board.
