6-9-3: PENALTIES:
   A.   Any person who violates the provisions of subsection 101.123(2), Wisconsin statutes, as incorporated herein shall be subject to a forfeiture of not less than one hundred dollars ($100.00) nor more than two hundred fifty dollars ($250.00) for each violation, together with the costs of prosecution, and in default of payment thereof, to imprisonment in the county jail until such forfeiture and costs are paid, but not to exceed eighty (80) days.
   B.   Except as provided in subsection C or D of this section, any person in charge who violates subsection 101.123(2m)(b) to (d), Wisconsin statutes, as incorporated herein shall be subject to a forfeiture of one hundred dollars ($100.00) for each violation, together with the costs of prosecution, and in default of payment thereof, to imprisonment in the county jail until such forfeiture and costs are paid, but not to exceed eighty (80) days.
   C.   For violations subject to the forfeiture under subsection B of this section, if the person in charge has not previously received a warning notice for a violation of subsection 101.123(2m)(b) to (d), Wisconsin statutes, as incorporated herein, the law enforcement officer shall issue the person in charge a warning notice and may not issue a citation.
   D.   No person in charge may be required under subsection B of this section to forfeit more than one hundred dollars ($100.00) in total, plus costs of prosecution, for all violations of subsection 101.123(2m)(b) to (d), Wisconsin statutes, as incorporated herein, occurring on a single day.
