4-3-18: REGULATION OF OTHER ANIMALS:
   A.   Restricted Species:
      1.   No person, except for a duly authorized licensed breeder, pet shop owner, commercial auction facility, farmer-owner of livestock permitted to be located within the village limits, or as otherwise set forth in this section, shall keep, sell, breed or offer for sale one or more horses, cows, pigs, goats, sheep, chickens, geese, ducks, doves, pigeons, other fowl or bees (collectively included as "creatures"), or construct or use shelters therefor within the village of Reedsville without the written permission of the village board or the chief of police or designee.
      2.   No person, except a pet shop owner, or as otherwise set forth in this section, or as permitted by the village board, shall keep, sell, breed, or offer for sale one or more large predators, endangered species or poisonous snakes, rodents, reptiles, exotic species or wild animals (collectively included as "creatures"), or construct or use shelters therefor within the village of Reedsville without the written permission of the village board or the chief of police or designee.
      3.   All stables, coops, yards, pens, kennels or other structures wherein any animal or creature is kept shall be constructed so as to be cleanable and kept in good repair. All such structures shall be kept clean and sanitary and shall not cause any objectionable odor. Accumulations of cleansings or manure of more than one day's operations in such structure shall be deemed a violation of this section and subject to a forfeiture action.
   B.   Captive Wildlife; Dogs: All provision of Wisconsin statutes, chapter 169 relating to wild animals, and chapter 174 relating to dogs, as amended or modified from time to time, are hereby incorporated by reference.
   C.   Creatures Not To Run At Large: No owner or keeper of any creature shall permit a creature to run at large at any time in the village of Reedsville. A creature is to be considered running at large if it is off the premises of the owner or keeper and not under control of the owner or some other person. Any police officer or humane officer may attempt to capture and restrain any such creature running at large as permitted by the Wisconsin statutes.
   D.   Loud Or Barking Animals: No person shall keep, harbor or own any dog, cat, or other animal that by loud or frequent or habitual barking, yelping, or howling, or by constant threat of attacking or biting, shall cause annoyance to the neighborhood or members of the public. No person shall refuse to deliver up to any police officer any dog, cat, or other animal when properly requested to do so under the provisions of this chapter.
   E.   Attacking Or Biting Creatures:
      1.   Keep, Harbor, Own: No person shall keep, harbor or own any creature which shall attack, bite or cause damage to any member of the public, a domestic animal or property of another whether the attack or damage is on public or private property, including the private property of the person owning the attacking or biting creature.
      2.   Removal Or Impoundment:
         a.   Removal: Any person ordered to remove any attacking or biting creature from the village of Reedsville shall do so immediately.
         b.   Impoundment: Any creature ordered by the village to be impounded shall be immediately surrendered to the village police to be detained until such time as a court order is obtained for the disposition of the animal or creature.
      3.   Costs Of Disposition: Any person keeping, harboring or owning an attacking or biting creature shall pay all costs for the removal, impoundment, destruction or other disposition of said animal.
      4.   Failing To Comply: Any person failing to comply with any written terms, conditions or restrictions imposed by the village regarding an attacking or biting creature shall be in violation of this section.
   F.   Furbearing Animal Farm Prohibited: No person, firm or corporation shall keep, operate, maintain or have a mink farm or farms, fox farms or other furbearing animal farm or farms within the corporate limits of the village of Reedsville, and the keeping, operating or maintenance of such a farm within the corporate limits of the village is hereby declared to be a public nuisance.
   G.   Wild Animals:
      1.   Prohibition On Keeping: Except for state licensed game farms, or otherwise provided herein, it shall be unlawful for any person to keep, maintain or have in his possession or under his control within the village any poisonous reptile or any other dangerous or carnivorous wild animal, insect or reptile, any vicious or dangerous domesticated animal or any other animal or reptile of wild, vicious or dangerous propensities. Specifically, it shall be unlawful for any person to keep, maintain or have in his possession or under his control within the village the following animals, reptiles or insects:
         a.   All poisonous animals and reptiles including rear fang snakes.
         b.   Chimpanzees (Pan); gibbons (Hylobates); gorillas (Gorilla); orangutans (Pongo); and siamangs (Symphalangus).
         c.   Baboons (Papio, Mandrillus).
         d.   Bears (Ursidae).
         e.   Bison (Bison).
         f.   Cheetahs (Acinonyx jubatus).
         g.   Crocodilians (Crocodilia) and alligators.
         h.   Constrictor snakes, three feet (3') in length or more.
         i.   Coyotes (Canis latrans).
         j.   Game cocks and other fighting birds.
         k.   Hyenas (Hyaenidae).
         l.   Jaguars (Panthera onca).
         m.   Leopards (Panthera pardus).
         n.   Lions (Panthera leo).
         o.   Lynxes (Lynx).
         p.   Ostriches (Struthio).
         q.   Pumas (Felis concolor); also known as cougars, mountain lions and panthers.
         r.   Sharks (class Chondrichthyes).
         s.   Snow leopards (Panthera uncia).
         t.   Tigers (Panthera tigris).
         u.   Wolves (Canis lupus).
         v.   Poisonous insects.
         w.   Except in properly zoned districts, horses, mules, ponies, donkeys, cows, pigs, goats, sheep, chickens, poultry or any animal raised for furbearing purposes unless otherwise permitted elsewhere in this code.
      2.   Exceptions; Pet Shops: The prohibitions of subsection G1 of this section shall not apply where the animals, reptiles or insects are in the care, custody or control of: a state licensed game farm; a veterinarian for treatment; agricultural fairs; shows or projects of 4-H clubs; a display for judging purposes; an itinerant or transient carnival, circus or other show; dog or cat show or trials; public or private educational institutions; zoological gardens, if:
         a.   Their location conforms to the provisions of the zoning ordinance of the village.
         b.   All animals and animal quarters are kept in a clean and sanitary condition and so maintained as to eliminate objectionable odors.
         c.   Animals are maintained in quarters so constructed as to prevent their escape.
   H.   Farm Animals; Existing Premises: The keeping of cattle, horses, hogs, poultry, alpaca, llamas, emus, and other farm animals is prohibited within the village except as may be allowed in areas zoned agricultural or industrial. Any such animals kept on premises other than those zoned agricultural or industrial within the village as of the effective date hereof may continue to be kept on such premises, provided that the owner of the premises registers the premises with the village as required herein. Notwithstanding the registration, there is not allowed any expansion of the area in which the animals are kept, or increase in the number or type of the animals kept, or replacement of any animals that die, are sold or otherwise transferred from the premises. The owner of the premises shall register the premises with the police chief or the village clerk by identifying the premises and the number and type of animals existing on the premises, within thirty (30) days of the effective date hereof. If the owner of the premises fails to register the animals within thirty (30) days of the effective date hereof, such animals are deemed in violation of this section.
   I.   Penalties: Violations of this section shall be punishable by a forfeiture of not less than twenty dollars ($20.00) or more than five hundred dollars ($500.00). (Ord. 2016-5, 7-14-2016)
