A. Definitions.
1. Approved Source means a source that is licensed and inspected by a recognized regulatory authority and whose license is in good standing.
2. Farm Food means food made from products grown or raised on a farm, including vegetables, mushrooms, herbs, nuts, shell eggs, honey or other bee products, flowers, nursery stock, livestock food products (including meat, milk, cheese, and other dairy products), and fish.
3. Farm Food Producer means a person, including family members and employees who grow, raise and harvest farm food to the point at which the products are ready for sale.
4. Farmers Market means a designated area where farm food producers and value-added processors gather on a consistently scheduled basis to sell farm food and value-added farm products from approved sources directly to the purchaser, as well as nonfood items, only if those items account for less than twenty-five percent (25%) of the overall sales at the farmers' market.
5. Value-added Processor means a person, including family members and employees, who processes a raw farm food product into items ready for sale, so long as a portion of the finished product was grown by the seller or seller's family members or employees.
6. Value-added Farm Product means any product processed by a value-added processor from farm food, such as baked goods, jams, and jellies.
B. Permitted Use.
1. Farmers' markets are a permitted use in zoning districts A. through S. of Chapter 122 (Zoning), Article 122-1, Sec 122-4 subject to the following regulations: Compliance with all laws. All farmers markets and their vendors must comply with all federal, state, and local laws and regulations relating to the operation, use, and enjoyment of the market premises, including but not limited to any requirements to obtain health permits, licenses, and certificates of insurance.
2. Operating hours shall be 7:00 a.m. to 9:00 p.m.
3. The City Manager has the right to issue additional regulations, guidance, and forms to promote this section.
