8.28.060   License—Application—Accompanying documents.
   At the time of filing an application for a license to hold, operate or conduct an outdoor mass gathering, the applicant, at the same time, shall also file:
   A.   Four copies of white background prints of a map drawn to scale, showing:
      1.   The location of the site relative to the nearest state highway or interstate highway,
      2.   The location of the automobile parking spaces and of all other areas to be used for other uses incidental to the outdoor mass gathering,
      3.   All interior access ways,
      4.   The location and detailed plans of all buildings and structures on the site or to be erected on the site, including any bandstands, stages or other facilities for performers or speakers,
      5.   The location of any loudspeakers,
      6.   The location of all toilet, medical, drinking and other facilities;
   B.   A document showing that the applicant is the owner of the site or an agreement in writing, notarized and signed by the owner of the site permitting such use of the premises and the filing of the application:
   C.   A document showing that the applicant is the owner of the land to be used for automobile parking spaces if land other than the site is to be used for this purpose, or an agreement in writing, notarized and signed by the owner of the land, if the owner is a person other than the person who owns the site, permitting such use of the premises and the filing of the application;
   D.   When the applicant is a corporation:
      1.   A certified copy of the articles of incorporation,
      2.   A certified copy of the bylaws of the corporation,
      3.   A certified copy of the corporate resolution wherein the person signing the application has been authorized to do so in the name of and on behalf of the corporation;
   E.   A consent to the entry, at any time in the course of his duties, of any peace officer, member or employee of the board, sheriff, county health officer, and any other county officer in the performance of his duties;
   F.   A written, signed and notarized agreement by and between the applicant and a person licensed to remove and dispose of trash, rubbish and debris within the county that, within seventy-two hours after the conclusion of the outdoor mass gathering, all trash, rubbish and debris will be removed from the site, from the land used for automobile parking spaces if it is land other than that used for the site, and from all other areas within one thousand feet of the exterior boundaries of the site. The full performance of such agreement shall be secured by a bond from a recognized surety licensed to transact business in the state or by a cash deposit filed with the board. The security for the performance of such agreement shall be in favor of the board and shall be equal in dollars to ten percent of the maximum estimate made by the applicant pursuant to Section 8.28.050B;
   G.   A notarized agreement signed by the applicant and by the owner of the site that they will reimburse all owners and occupants of property adjoining the site and any person attending the outdoor mass gathering for all damages of any kind to such owners, occupants, or person or to their property caused by the applicant, the owner of the site, or by any person attending the outdoor mass gathering, which damage would not have occurred had the outdoor mass gathering not been held, operated or conducted, and a policy of insurance or an agreement accompanied by a cash deposit with the board equal in amount to the maximum limits of liability required of the policy of insurance or a combination of both equal in amount to the maximum limits of liability required by the policy of insurance if submitted alone;
   H.   A notarized written statement signed by the director of the county health department showing:
      1.   That prior to filing the application for a license, the applicant provided the department with that information required of the applicant by subsections A, B and F of Section 8.28.050; and
      2.   That prior to filing the application for a license, the department reviewed and approved the arrangements, plans and agreements made by the applicant for protecting the health, safety and welfare of the people expected to attend the outdoor mass gathering each day, including, but not limited to, arrangements, plans and agreements for providing:
         a.   Both men and women at the site with an adequate number of sanitary toilet facilities,
         b.   At least one trash can or receptacle with a thirty-two-gallon capacity for every twenty-five people expected to attend the outdoor mass gathering each day,
         c.   An ample supply of water suitable for human consumption and suitable for sanitation purposes,
         d.   Those in attendance with camping facilities and sleeping areas when those attending will be permitted to remain overnight on the site on any date or dates during which the outdoor mass gathering is to be held, operated or conducted,
         e.   Those in attendance with an ample supply of food of a quality fit for human consumption when the site is located a substantial distance from markets, restaurants or like eating establishments as determined by the department;
   I.   A notarized written statement signed by the sheriff of the county showing:
      1.   That prior to filing the application for a license, the applicant provided the sheriff with that information required of the applicant by subsections A, B, F and G of Section 8.28.050; and
      2.   That prior to filing the application for a license, the sheriff reviewed and approved the arrangements, plans and agreements made by the applicant for protecting the health, safety and welfare of the people expected to attend the outdoor mass gathering each day, including, but not limited to, arrangements, plans and agreements for providing:
         a.   At least one private patrolperson or security guard for every five hundred people expected to attend the outdoor mass gathering each day, each of whom shall be a licensed patrolperson or guard, shall be wearing a uniform at all times the outdoor mass gathering is in operation, and shall be under the direction and control of the sheriff,
         b.   An adequate number of automobile parking spaces,
         c.   Ingress and egress for both automobiles and people to and from the site of the outdoor mass gathering and to and from the site of the automobile parking spaces,
         d.   An adequate number of private persons to direct and control the movement of automobiles on the site of the outdoor mass gathering and on the site of the automobile parking spaces,
         e.   An adequate number of private persons to prevent more people from attending the outdoor mass gathering than the maximum estimated by the applicant pursuant to Section 8.28.050B,
         f.   Adequate illumination of the site of the outdoor mass gathering, the site of the automobile parking spaces and camping and sleeping areas when people are permitted to remain on any of the foregoing sites or areas after dark;
   J.   A notarized written statement signed by the county engineer showing:
      1.   That prior to filing the application for license, the applicant provided the engineer with that information required of the applicant by subsections A, B, C, E and F of Section 8.28.050;
      2.   That prior to filing the application for a license, the engineer reviewed and approved the arrangements, plans and agreements made by the applicant for protecting the health, safety and welfare of the people expected to attend the outdoor mass gathering each day, including, but not limited to, arrangements, plans and agreements for providing:
         a.   Well-constructed structures or buildings on the site of the outdoor mass gathering, the site of the automobile parking spaces, and areas established for camping and sleeping,
         b.   An emergency communications system sufficient to meet the emergency requirements of the sheriff of the county,
         c.   A safe electrical system for both communications and illumination.
