§ 154.070 LANDSCAPING.
   (A)   All unpaved areas within the street rights-of-way shall be seeded or sodded within 12 months from the date of the issuance of a building permit for the development. All residential lawns shall similarly be seeded and/or sodded within 12 months of occupancy.
   (B)   Not less than 10% of the amount of the original letter of credit shall be deposited with the Village Board of Trustees until such time as all such seeding and sodding have been fully completed and accepted by the Village Engineer. The deposit shall be held for 12 months and shall guarantee the satisfactory growth and maintenance of any landscaping improvements made to the development.
   (C)   Before the release of the final amount of the letter of credit for the 12 month maintenance period can be recommended by the Village Engineer, all unpaved areas between the edge of the road pavement and the right-of-way line must support an adequate mat of grass. Any and all reasonable provisions shall be made to assure the growth of all landscaping.
   (D)   (1)   Street trees shall be planted on both sides of each proposed street except where there are existing trees present and preserved, as determined by the Village Engineer. Street trees newly planted shall not be further apart than 50 feet or one tree per inside lot and two trees on corner lots and the type of tree shall be limited to those varieties as approved by the Plan Commission.
      (2)   Newly planted street trees shall be at least 1½ inches in caliper measured one foot from the ground.
      (3)   The planting of the following varieties of trees shall be prohibited:

   (E)   Screen planting required. Protective screen planting may be required to secure a reasonably effective physical barrier between residential properties and adjoining uses to minimize adverse conditions of sight and sound. The screen planting plan shall be prepared by a landscape architect and shall meet the approval of the Village Administrator or his or her designee.
   (F)   Variations. The Village Administrator may grant variations from the requirements of this section, other than division (D)(3), in specific cases as specified in § 154.115(A) of this code. Variations to division (D)(3), where sought, are subject to the variation process in § 154.115(B) of this code.
