§ 113.05 NON-CONFORMING USES ON STATE, SECONDARY, COUNTY, AND PRIVATE ROADS. 
   (A)   Continuation requirements.
Non-conforming junkyards and open storage areas, those not meeting the minimum requirements of this chapter and subsequently operating without a permit as required in § 113.06 of these regulations, are declared to be in violation of this chapter.
      (1)   Such non-conforming uses are not re-established after discontinuance or abandonment for a period of three months.
      (2)   Such non-conforming uses are not enlarged or altered in any way which increases their non-conformity.
   (B)   Basis for revoking license. A licensed non-conforming junkyard shall have its license revoked, after which it shall be treated as a new junkyard at a new location, if any of the following occurs:
      (1)   Use of the non-conforming junkyard is voluntarily discontinued or a change of the non-conforming use to some other kind of use is made, which shall constitute abandonment.
      (2)   The location of the non-conforming junkyard is changed as a result of a right-of-way taking or for any other reason.
      (3)   The non-conforming junkyard is extended or enlarged at its present location without conforming to § 113.04.
