§ 80.01 DEFINITIONS.
   For purposes of this chapter the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   BUSINESS. A voluntary organization composed of individuals and businesses who have joined together to advance the commercial, financial, industrial and civic interests of a community.
   CHARITABLE. An organization or institution organized and operated to benefit an indefinite number of the public. The service rendered to those eligible for benefits must also confer some benefit on the public.
   CITY ROADWAYS. Any of the streets or alleys within the corporate limits of the city, except for state and county streets or roads.
   EDUCATIONAL. An organization or institution organized and operated to provide systematic instruction in useful branches of learning by methods common to schools and institutions of learning which compare favorably in their scope and intensity with the course of study presented in tax supported schools.
   FRATERNAL. An organization of persons having a common interest, the primary interest of which is to both promote the welfare of its members and to provide assistance to the general public in such a way as to lessen the burdens of government by caring for those that otherwise would be cared for by the government.
   GOLF CART. A vehicle specifically designed and intended for the purposes of transporting one or more persons and their golf clubs and/or maintenance equipment while engaged in the playing of golf, supervising the play of golf, or maintaining the condition of the grounds on a public or private golf course.
   LABOR. An organization composed of workers organized with the objective of betterment of the conditions of those engaged in such pursuit and the development of a higher degree of efficiency in their respective occupations.
   NEIGHBORHOOD VEHICLE. A self-propelled, electronically powered four-wheeled motor vehicle (or a self-propelled gasoline-powered four-wheeled motor vehicle with an engine displacement under 1,200 cubic centimeters) which is capable of obtaining in one mile a speed of more than 20 miles per hour, but not more than 25 miles per hour, and which conforms to federal regulations under Title 49 C.F.R. Part 571.500.
   NON-PROFIT. An organization or institution organized and conducted on a not-for-profit basis with no personal profit inuring to anyone as a result of the operation.
   OPERATE. To control the operation of a neighborhood vehicle or golf cart.
   OPERATOR. A person who operates or is in actual control of a neighborhood vehicle or golf cart.
   RECREATIONAL OFF-HIGHWAY VEHICLE or UTILITY TASK VEHICLE (collectively "UTV"). Any motorized off-highway device designed to travel primarily off-highway, 64 inches of less in width, having a manufacturer's dry weight of 2,000 pounds or less, traveling on four or more non-highway tires, designed with a non-straddle seat and a steering wheel for steering control, except equipment such as lawnmowers.
   RELIGIOUS. Any church, congregation, society, or organization founded for the purpose of religious worship.
   VETERANS. An organization or association comprised of members of which substantially all are individuals who are veterans or spouses, widows, or widowers of veterans, the primary purpose of which is to promote the welfare of its members and to provide assistance to the general public in such a way as to confer a public benefit.

§ 80.02 PERMITS.
   (A)   No person shall operate a neighborhood vehicle, golf cart or UTV within the city without first obtaining a permit from the Police Department as provided herein.
   (B)   Neighborhood vehicles, golf cart and UTV owners shall complete a permit application form and such forms are available at the Police Department. The completed forms shall be maintained by the city.
   (C)   All neighborhood vehicles, golf carts and UTVs must be inspected by a designated officer of the Police Department to ensure that the neighborhood vehicle, golf cart or UTV is safe to operate on city roadways and is in compliance with this chapter and with the State of Illinois Motor Vehicle Code.
   (D)   Any person who operates a neighborhood vehicle, golf cart or UTV must present valid proof of liability insurance or personal injury and property damage with limits of liability not less than the minimum required by the State of Illinois for passenger vehicles. Insurance coverage will be verified as in effect by the city when issuing or renewing a permit.
   (E)   Permits shall be granted for a period of one year and may be renewed annually.
   (F)   The cost of the permit shall be $25 per neighborhood vehicle, golf cart or UTV.
   (G)   Permits shall be displayed at all times on the rear of all neighborhood vehicles, golf carts and UTVs.
   (H)   Special use permit. A special use permit license shall allow a licensee to operate a neighborhood vehicle, golf cart or UTV within the city for a period not to exceed 24 continuous hours. A special use permit license may be granted only to a unit of state or local government or issued to bona fide religious, charitable, labor, business, fraternal, educational or veterans organizations that operate without profit to their members and which have been in existence continuously for a period of five years immediately before making application for a license and which have had during that entire five-year period a bona fide membership engaged in carrying out their objectives. A licensee shall be limited to three special use permit licenses in a calendar year. There shall be no fee for the issuance of a special use permit license.

§ 80.03 EQUIPMENT REQUIRED.
   (A)   No person shall operate any neighborhood vehicle or UTV within the city unless such neighborhood vehicle meets or exceeds the equipment requirements set forth in ILCS Ch. 625, Act 5, § 11-1426.1(e) and must be equipped with seatbelts for the rear seats.
   (B)   No person shall operate any golf cart within the city unless such golf cart meets or exceeds the equipment requirements set forth in ILCS Ch. 625, Act 5, § 1 l-1428(e) and must be equipped with seat belts for the rear seats.

§ 80.04 REGULATIONS.
   Neighborhood vehicles, golf carts and UTVs may only be operated on city roadways within the city in accordance with the following regulations:
   (A) Any person who operates a neighborhood vehicle, golf cart or UTV must be at least 18 years of age and possess a valid driver's license to operate a motor vehicle issued by Illinois or any other state.
   (B)   All passengers must be seven years of age or older.
   (C)   The maximum occupancy of the golf carts traveling on city roadways will be one person per bucket seat or two people per bench seat.
   (D)   Every neighborhood vehicle, golf cart or UTV shall have its headlights and tail lamps lighted at all times when operated on city roadways.
   (E)   Any person operating or who is in actual physical control of a neighborhood vehicle, golf cart or UTV as described herein on a city roadway while under the influence of alcohol or drugs is subject to ILCS Ch. 625, Act 5, §§ 11-500 through 11-502.

§ 80.05 DESIGNATED AREAS AND TIMES AVAILABLE FOR USE.
   (A)   Neighborhood vehicles, golf carts and UTVs may only be operated on city roadways under the jurisdiction of the city, unless it meets an exception as provided herein.
   (B)   No person operating a neighborhood vehicle, golf cart or UTV shall make a direct crossing upon or across any highway under the jurisdiction of the State of Illinois or an interstate highway except at an intersection of the highway with another public street, road or highway.
   (C)   Neighborhood vehicles, golf carts and UTVs may not be operated on sidewalks within the city, other than parking areas.
   (D)   No person shall operate a neighborhood vehicle, golf cart or UTV when visibility is impaired by weather, smoke, fog of other conditions or at any time when there is insufficient light to clearly see persons and vehicles on a city roadway at a distance of 500 feet.

§ 80.06 UNATTENDED VEHICLES.
   It is unlawful for the owner or operator to leave or allow a neighborhood vehicle, golf cart or UTV to be or remain unattended on public property while the motor is running or with the keys for starting the vehicle left in the ignition.
