(A) Any person violating any provision of this chapter, for which no other penalty is provided, shall be subject to the penalty provisions of § 10.99.
(B) Whoever is convicted of or is found guilty of a violation of § 70.01 shall be guilty of a minor misdemeanor and shall be fined not more than $100 for the first such offense; whoever is convicted of or is found guilty of a second offense within one year after the first offense shall be guilty of a misdemeanor of the fourth degree and shall be imprisoned or jailed for not more than 30 days and fined not more than $250; whoever is convicted of or is found guilty of each subsequent offense after the first and second offense within one year shall be guilty of a misdemeanor of the third degree and shall be imprisoned or jailed not more than 60 days and shall be fined not more than $500.
(C) The penalty for violation of § 70.02 shall be as follows:
(1) The first offense shall be considered a minor misdemeanor with a fine not to exceed $100; and
(2) The second offense shall be considered a misdemeanor of the fourth degree with a fine not to exceed $250 and a jail sentence not to exceed 30 days.
(D) Whoever violates § 70.03 is guilty if a minor misdemeanor on a first offense; on a second offense within one year after the first offense, the person is guilty of a misdemeanor of the fourth degree; on each subsequent offense within one year after the first offense, the person is guilty of a misdemeanor of the third degree.
(E) Whoever violates § 70.04 as a first offense is guilty of a misdemeanor of the first degree.
